ORDINANCE
NO. 160447, AS AMENDED
Accepting and approving the recommendation of the Tax Increment
Financing Commission of Kansas City, Missouri, as to the Fifth Amendment of the
Downtown Library Tax Increment Financing Plan; estimating and appropriating the
sum of $5,300 for purposes of assisting the Veteran’s Community Project;
designating requisitioning authority; and directing the City Clerk to transmit
copies of this ordinance.
WHEREAS, pursuant to the Real Property Tax Increment
Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes
of Missouri, as amended (the “Act”), the City Council of Kansas City, Missouri
created the Tax Increment Financing Commission of Kansas City, Missouri (the
"Commission"); and
WHEREAS,
the Commission recommended approval of the Downtown Library District Tax
Increment Financing Plan (the “Redevelopment Plan”), and the Redevelopment Plan
was approved by Ordinance No. 021400 on November 26, 2002; and
WHEREAS,
the Redevelopment Plan has previously been amended four times by Ordinance No.
040196, Ordinance No. 051526, Committee Substitute for Ordinance No. 150151,
and Ordinance No. 150989; and
WHEREAS, the Commission has been duly constituted and its
members appointed; and, after all proper notice was given, the Commission met
in public hearing and after receiving the comments of all interested persons
and taxing districts with respect to the Redevelopment Plan, closed said public
hearing on May 11, 2016, and adopted its Resolution No. 5-17-16 (the
“Resolution”) recommending to the City Council the approval of the Fifth
Amendment of the Redevelopment Plan; and
WHEREAS, implementation of the Fifth Amendment will result in
a distribution of a certain portion of accumulated PILOTS within the Special Allocation
Fund, and the City will receive a portion of such distribution; and
WHEREAS, the Veterans Community Project is a nonprofit
organization created to house homeless veterans in tiny houses; and
WHEREAS, Veterans Village is a four-acre village located on a
Land Trust parcel in Kansas City at 89th and Troost, that will
ultimately provide a community of such tiny houses; and
WHEREAS, the housing of veterans and the remediation of
homelessness serve a public purpose which the City desires to advance by
providing financial assistance that, together with private contributions, will
provide funding for the City to sponsor the construction of a tiny house; NOW,
THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Fifth Amendment of the Downtown Library
Tax Increment Financing Plan is hereby approved.
Section
2. All terms used in this ordinance, not otherwise defined herein, shall be
construed as defined in the Real Property Tax Increment Allocation
Redevelopment Act, Sections 99,800 to 99.865, RSMo.
Section
3. The City Council hereby finds that good cause has been shown for the
amendment of the Redevelopment Plan and that the findings of the Council in
Ordinance Nos. 021400, 040196, 051526, 150151 and 150989, are not affected by
the Fifth Amendment and apply equally to the Fifth Amendment.
Section
4. That the revenue in the following account is hereby estimated in the
following amount:
17-2570-120000-450980 Surplus
PILOTs $5,300.00
Section
5. That the sum of $5,300.00 is hereby appropriated to the following
account:
17-2570-648504-B-64017102 Veterans
Community Project $5,300.00
Section
6. That the Director of City Planning and Development is designated as
requisitioning authority for Account No. 17-2570-648504.
Section
7. That the City Clerk shall send a copy
of this ordinance to the County Clerk and County Executive of Jackson County,
Missouri.

I hereby certify that
there is a balance, otherwise unencumbered, to the credit of the appropriation
to which the foregoing expenditure is to be charged, and a cash balance,
otherwise unencumbered, in the treasury, to the credit of the fund from which
