COMMITTEE SUBSTITUTE RESOLUTION NO. 010098

 

Authorizing submission of an application to the Missouri Department of Economic Development in conjunction with the Planned Industrial Expansion Authority of Kansas City, Missouri for the purpose of requesting grant funds for public capital improvements for infrastructure in the Lewis & Clark Redevelopment Area of the Central Industrial District and indicating the intention of the Council to own and operate such improvements.

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri (PIEA) is a public body created pursuant to Ordinance No. 34677 adopted by the City Council of Kansas City, Missouri (City Council) on February 9, 1968, in accordance with Sections 100.300-100.620, RSMo (the PIEA Law) and the PIEA is transacting business and exercising the powers granted to it by applicable law; and

 

WHEREAS, upon recommendation of the PIEA, the City Council approved the Central Industrial District Plan by Ordinance No. 48892, subsequently amended by Ordinance No. 56866; and

 

WHEREAS, certain properties located at 940, 1000 and 1100 W. 8th Street in the Central Industrial District have been damaged by fire, and are otherwise dilapidated in a state of disrepair creating blight and a danger to public safety; and

 

WHEREAS, significant sums of money have been spent by the City of Kansas City, Missouri to contain the blight and dangerous conditions that exist on these properties and secure the properties from public access; and

 

WHEREAS, the PIEA has obtained fee simple title to 1000 and 1100 W. 8th Street and is in the process of acquiring title to 940 W. 8th Street (hereafter the Sites); and

 

WHEREAS, the PIEA has previously submitted an application for participation in the Missouri Department of Natural Resources Voluntary Cleanup Program to address the environmental remediation of the Sites and has subsequently received their approval of the Remedial Action Plan to effect clean-up and authorization for issuance of Brownfield Remediation Tax Credits to pay for eligible clean-up expenses; and

 

WHEREAS, the PIEA adopted Resolution No. 608 on December 15, 2000 authorizing the submission of an application to the Missouri Department of Economic Development (MDED) for a Brownfield Infrastructure Grant to construct roadway, curb, gutter, sidewalk, and trail improvements (hereafter, the Project) to serve the Sites; and

 

WHEREAS, the City adopted Resolution No. 001563 on November 30, 2000 authorizing an application to the Missouri Development Finance Board (MDFB) for funds to construct similar type improvements (hereafter Improvements) in areas adjacent to the Sites and which, when completed, will tie-into the Project and result in improved transportation and circulation systems in the Lewis & Clark Area of the Central Industrial District; NOW, THEREFORE,


BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council determines that the Improvements will be a public benefit and that this method of financing will be cost effective and beneficial to the City.

 

Section 2. The City Council does hereby authorize the submission of an application in conjunction with the PIEA for a grant in the amount of $607,439.00 for construction of the Improvements.

 

Section 3. The Council states its intention to own and operate the Improvements after completion.
