COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001070

 

Declaring the area generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west, to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Urban Renewal Plan for the same, said plan to be known as the Westport Housing Urban Renewal Plan.

 

WHEREAS, Section 99.430, Revised Statutes of Missouri, provides that a legislative body may approve a declaration of blight and approve an urban renewal plan for the same area simultaneously; and

 

WHEREAS, it is desirable and in the public interest that the Land Clearance for Redevelopment Authority of Kansas City, Missouri, submit an Urban Renewal Plan for the area generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west; and

 

WHEREAS, said area is blighted due to the insanitary or unsafe conditions, deterioration of site improvements, and a combination of such factors so as to constitute an economic or social liability to the public health, safety, morals or welfare; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on the 19th day of July, 2000, adopt a resolution recommending that the area be declared blighted and recommending approval of an Urban Renewal Plan for the area generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west, said resolution being set forth and incorporated in the Urban Renewal Plan; and

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the designation of blight and approval of the Urban Renewal Plan on August 1, 2000, as evidenced by its resolution recommending approval of the adoption of said plan and found said plan to be in conformance with the Master Plan for the development of the community as a whole, subject to certain conditions, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the proposed urban renewal area identified as the Westport Housing Urban Renewal Plan generally bounded by Westport Avenue and Archibald Street on the north, 43rd Street on the south, Bridger Road on the east and Roanoke Road on the west, and more specifically described as:

 

A tract of land lying in the Southeast Quarter of Section 19, Township 49 North, Range 33 West, said tract also being a portion of Whitehouse Place, Hornbecks Park, Belleview Place, Jones and Fishers Addition and Westport Plaza Place, all


subdivisions in Kansas City, Jackson County, Missouri, more particularly described as follows: All of Lots 5 thru 20 inclusive, and all of Lots 25 and 26, and all of Lots 28 thru 38, inclusive, and all of Lot 40, in said Whitehouse Place; together with all of Lots 10 thru 35 inclusive, said Hornbecks Park; together with all of Lots 1 thru 4, in said Belleview Place; together with all of Lots 31 and 32, and the east 34.10 feet of Lot 30, said Jones and Fishers Addition; together with all of Lot 1, said Westport Plaza Place; together with the platted alley lying between said Belleview Place and Jones and Fishers Addition, and the south half of the west 284.00 feet of vacated Archibald Street, as described in Vacation Ordinance No. 941375, as recorded in the Jackson County Register of Deeds Office; together with Jefferson Street from the north right of way line of Archibald Street to the southwesterly prolongation of the northerly line of Lot 20 said Whitehouse Place; together with Archibald Street from the west right of way line of Bridger Road to Clark Avenue; together with Clark Avenue from the northeasterly prolongation of the northerly line of Lot 32 said Jones and Fishers Addition to the westerly prolongation of the north line of the south 15 feet of Lots 24 thru 35 said Hornbecks Park; together with the east/west alley first north of 43rd Street, from the west right of way line of Bridger Road to the east right of way line of Clark Avenue, except the south 15 feet of Lots 24 thru 35, inclusive, said Hornbecks Park, and except the south 15 feet of Lot 1, said Belleview Place.

 

is a blighted area and is in need of redevelopment and rehabilitation and is appropriate for an Urban Renewal Project, and that the undertaking by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, of surveys and plans for an urban renewal project of a character contemplated by Section 99.430, Revised Statutes of Missouri, as amended, and the proposed urban renewal area is hereby approved.

 

Section 2. That the Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, Revised Statutes of Missouri, as amended.

 

Section 3. That the Urban Renewal Plan which is known as the Westport Housing Urban Renewal Plan, dated August 30, 2000, a copy of which is on file in the office of the City Clerk under Document No. 001070 and which is incorporated herein by reference, is hereby approved, subject to the following condition:

 

That the Westport Housing Urban Renewal Plan be revised in the following manner:

 

a. That Appendix Ia - City Design Guideline be revised as follows:

 

i. Delete Section V.B.4 in its entirety.

 

ii. Delete Section V.B.3 in its entirety and replace it with a new V.B.3 to read as follows:

V.B.3. A majority of residential buildings should front onto streets.

 

b. That City Plan Commission disposition letter dated August 3, 2000, set out as an attachment be revised to reflect that conditions 7 and 8 apply only to Clark Street and not to Jefferson Street.

 

Section 4. That said Urban Renewal Plan is hereby found to be feasible and in conformance with the Master Plan for the development of the community as a whole.
