ORDINANCE NO. 971660

 

Approving the preliminary plat of The Old Milwaukee Yard Subdivision on a 2.7 acre tract of land located on the south side of 22nd Street from Broadway Avenue to Wyandotte Trafficway. (SD 0808)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of The Old Milwaukee Yard Subdivision on a 2.7 acre tract of land located on the south side of 22nd Street from Broadway Avenue to Wyandotte Trafficway and more specifically described as follows:

 

A tract of land located in the northwest quarter of Section 8, Township 49, Range 33, in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the southwest corner of the northwest quarter of said Section 8; thence north 89 degrees 57 minutes 30 seconds east along the south line of said northwest quarter a distance of 40.00 feet to a point on the east right-of-way line of Broadway Boulevard as now established, said point being the point of beginning of the tract to be described, thence north 00 degrees 18 minutes 30 seconds west, along said east right-of-way line a distance of 155.72 to a point on the southerly right-of-way line of 22nd Street as now established; thence north 58 degrees 22 minutes 24 seconds east, along said southerly right-of-way of said 22nd Street 876.67 feet; thence south 00 degrees 37 minutes 48 seconds east a distance of 222.62 feet to a point on a line that is 15 feet northerly of and parallel to the centerline of Kansas City Terminal Railway Companys track number 276; thence south 68 degrees 49 minutes 43 seconds west along said parallel line a distance of 373.60 feet; thence continuing along said parallel line on a curve to the left, tangent to the last described course, having a radius of 980.00 feet and an arc length of 313.59 feet; thence south 50 degrees 29 minutes 40 seconds west along said parallel line a distance of 157.46 feet to a point on the south line of said northwest quarter; thence south 89 degrees 57 minutes 30 seconds west along said south line a distance of 8.72 feet to the point of beginning. Contains 118.699 square feet or 2.725 acres more or less. Subject to any and all easements, reservations and restrictions of record.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer dedicate additional right-of-way to provide a total of 25 feet from centerline on the south side of 22nd Street.

 

3. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval with the next final plat and that the developer make any improvements as required by the City Engineers Office.

 


4. That the developer enter into a deferral agreement to improve 22nd Street to local street standards including curb, gutter, streetlights and sidewalks on the south side.

 


5. That the developer submit plans for site grading, silt and erosion control for permitting prior to beginning any construction activities.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 971660, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
