RESOLUTION NO. 051356

 

Declaring the additional area of approximately .30 acres generally located at the northeast corner of 12th Street and McGee Street a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Planned Industrial Expansion Authority Law and accepting the Amended Blight Study for the Downtown Loop General Development Plan Area.

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, (the Authority) adopted Resolution No. 790 on August 15, 2003, finding that the area described in the Resolution to be blighted pursuant to the PIEA Law and recommending to the City Council that said area be designated as a blighted, insanitary or underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo; and

 

WHEREAS, said area was declared to be blighted by the City Council through passage of Committee Substitute for Ordinance No. 040146 on March 4, 2004, and a General Development Plan was approved for the area known as the Downtown Loop General Development Plan; and

 

WHEREAS, on October 26, 2005, the Authority adopted Resolution No. 1050 accepting the Amended Blight Study for the Downtown Loop PIEA Area and finding the additional area of approximately .30 acres located at the northeast corner of 12th Street and McGee Street to be a blighted, insanitary or underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo;

 

WHEREAS, Section 100.400, RSMo, provides that a general development plan may be prepared subject to the declaration that the area is blighted or insanitary and in need of redevelopment and rehabilitation; and

 

WHEREAS, it is desirable and in the public interest that the PIEA undertake preparation of an amended general development plan for the expansion of the Downtown Loop General Development Plan to include the area of approximately .30 acres generally located at the northeast corner of 12th Street and McGee Street; and

 

WHEREAS, said area is blighted due to insanitary, or unsafe conditions, deterioration of improvements, the existence of conditions which endanger life or property by fire or other causes or a combination of such factors so as to constitute an economic or social liability to the public, health, safety, morals or welfare; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the additional area of approximately .30 acres generally located at the northeast corner of 12th Street and McGee Street, more specifically described as follows:

 

Tax Parcel No. 29-220-51004-00-0-00-000 (306 E. 12th Street):

 

The East 40 feet of Lots 135 and 136 except that part of the East 40 feet of Lot 135 in Twelfth Street, SWOPES ADDITION TO THE CITY OF KANSAS, now Kansas City, Jackson County, Missouri; and

 

Tax Parcel No. 29-220-51-05-00-0-00-000 (no address):

 

The South 10 feet of Lot 137 and the West 92 feet of Lofts 135 and 136, in SWOPES ADDITION TO THE CITY OF KANSAS, now Kansas City, Jackson County, Missouri, except that portion taken for street purposes.

 

is a blighted area in need of redevelopment and rehabilitation and is appropriate for an industrial development project, and that the undertaking by the Planned Industrial Expansion Authority of Kansas City, Missouri, of surveys and plans for an industrial development project of the character contemplated by Section 100.400, RSMo, is hereby approved and its addition to the Downtown Loop General Development Plan Area is appropriate. The Council accepts the findings of the Amended Blight Study for the Downtown Loop General Development Plan Area. All findings of the Council by Committee Substitute for Ordinance No. 040146 shall remain in full force and effect.

Section 2. That this Council has duly made the findings necessary for compliance with Sections 100.310 and 100.400, RSMo.
