ORDINANCE NO. 180967

 

Authorizing the Director of Public Works to amend Master License Agreements with ExteNet Systems, Inc., Google Inc., Mobilitie Investment III, LLC, Selected Site Consultants, Inc., Sprint Spectrum L.P., and Verizon Wireless (VAW) LLC, respectively, to install and maintain poles within City right-of-way and to attach small wireless facilities to City poles to provide wireless digital data communications.

 

WHEREAS, on September 15, 2014, ExteNet Systems, Inc. (“ExteNet”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 140718; and

 

WHEREAS, on April 28, 2016, Google Inc. (“Google”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 160247; and

 

WHEREAS, on February 19, 2015, Mobilitie Investment III, LLC (“Mobilitie”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 150087; and

 

WHEREAS, on September 7, 2017, Mobilitie and Kansas City executed the First Amendment to the Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 160519; and

 

WHEREAS, on March 1, 2016, Selective Site Consultants, Inc. (“SSC”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 150559; and

 

WHEREAS, on August 22, 2017, SSC and Kansas City executed the First Amendment to the Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 170471; and

 

WHEREAS, on June 20, 2017, Sprint Spectrum L.P. (“Sprint Spectrum”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 170411; and

 

WHEREAS, on September 26, 2017, Verizon Wireless (VAW) LLC (“Verizon”) and Kansas City entered into a Master License Agreement for Attachment to City Facilities which was authorized by Ordinance No. 170422; and

 

WHEREAS, the legislature of the State of Missouri passed House Bill No. 1991 (“H.B. 1991”) which, among other things, prescribes limits on fees and rates the City may charge for installation, replacement, or modification of poles and associated small wireless facilities within the right-of-way and for attachment of small wireless facilities to City poles; and

 

WHEREAS, amendment of the agreements discussed herein may be necessary in order to comply with H.B. 1991; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director Public Works is authorized to execute amendments to the Master License Agreements with ExteNet Systems, Inc., Google Inc., Mobilitie Investment III, LLC, Selected Site Consultants, Inc., Sprint Spectrum L.P., and Verizon Wireless (VAW) LLC, respectively, as necessary to bring said agreements into compliance with H.B. 1991. Copies of the finalized amendments in substantial form are on file in the office of the Director of Public Works.
