ORDINANCE NO. 011756

 

Approving the preliminary plat of South Oak on an approximately 0.62 acre tract of land generally located at the northwest corner of East 85th Street and Oak Street. (SD 0983)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of South Oak on an approximately 0.62 acre tract of land generally located at the northwest corner of East 85th Street and Oak Street, and more specifically described as follows:

 

TRACT 1: The south 80 feet of the north 381 feet of the east 165 feet of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 20, Township 48, Range 33, in Kansas City, Jackson County, Missouri, except that part in street.

 

TRACT 2: The north 120 feet of the south 280 feet of the east 165 feet of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 20, Township 48, Range 33, in Kansas City, Jackson County, Missouri, except the east 30 feet taken for street.

 

OVERALL TRACT: The north 200 feet of the south 360 feet of the east 165 feet of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter of Section 20, Township 48, Range 33, in Kansas City, Jackson County, Missouri, except that part in streets.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer secure approval from the Board of Zoning Adjustment for variances to the required front and side yard setbacks required pursuant to Section 80-43 of the Zoning Ordinance to allow the existing residences located on the west side of Oak Street to remain.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 011756, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
