ORDINANCE NO. 140478

 

Amending the 2012 and 2013 One Year Action Plans and authorizing submission of a Substantial Amendment to the U.S. Department of Housing and Urban Development (HUD) for its consideration; estimating revenue in the amount of $1,290,743.00 in the HOME Investment Fund; appropriating $1,290,743.00 from the Unappropriated Fund Balance of the HOME Investment Fund; appropriating $725,000.00 from the Unappropriated Fund Balance of the Special Housing Rehabilitation Loan Fund; authorizing the Director of Neighborhoods and Housing Services Department to enter into a contract, financing agreement and loan documents in the amount of $1,890,743.00 with Oak Point Partners, LLC to construct 30 units of affordable rental housing upon approval by the U.S. Department of Housing and Urban Development; and designating requisitioning authority.

 

WHEREAS, on January 26, 2012, through Resolution No. 120050, City Council supported the submission of an Urban Renewal Plan for the Vineyard General Development Planning Area and the issuance of a Request for Qualifications and Proposals for a developer to implement the revised Oak Point Replacement Housing Plan; and

 

WHEREAS, Oak Point Partners, LLC responded to the Request for Qualifications and Proposals and was selected as the developer for the Oak Point Replacement Housing Plan to construct 30 units of affordable 3 bedroom, 2.5 bathroom residential housing units at 38th Street and Elmwood Avenue and scattered sites around 44th and Norwood Avenue; and

 

WHEREAS, the City has an obligation with the United States Department of Housing and Urban Development to complete the Oak Point project; and

 

WHEREAS, on March 8, 2012, through Committee Substitute for Resolution No. 120159, the Council approved the 2012 One-Year Action Plan which identified HOME funds for the development of affordable rental housing; and

 

WHEREAS, on January 24, 2013, through Resolution No. 121077, the Council approved the 2013 One-Year Action Plan which identified HOME funds for the development of affordable rental housing; and

 

WHEREAS, $747,000 of project costs are being financed by 2012 HOME funds; $543,743 of project costs are being financed by 2013 HOME funds; and $700,000 of the project costs are non-federal funds collected for Housing Development; and

 

WHEREAS, authorization is required from the City Council in order for the Director to enter into a contract; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY

 

Section 1. That the Substantial Amendments to the 2012 and 2013 One Year Action Plans prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which are attached hereto in substantial form, are hereby approved.

 

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Substantial Amendments to the United States Department of Housing and Urban Development.

 

Section 3. That $1,290,743.00 in revenue is estimated in the following account of the HOME Investment Fund:

 

15-2940-570001-476050-G57HOME13 HUD Grants $ 543,743.00

15-2940-550001-476050-G55HOME12 HUD Grants 747,000.00

TOTAL $ 1,290,743.00

 

Section 4. That $1,290,743.00 is appropriated from the Unappropriated Fund Balance of the HOME Investment Fund in the following accounts of the HOME Investment Fund:

15-2940-575326-A-G57HOME13 Housing Services $ 50,000.00

15-2940-575326-B-G57HOME13 Housing Services 493,743.00

15-2940-555316-B-G55HOME12 Housing Services 747,000.00

TOTAL $ 1,290,743.00

 

Section 5. That $725,000.00 is appropriated from the Unappropriated Fund Balance of the Special Housing Rehabilitation Loan Fund in the following accounts of the Special Housing Rehabilitation Loan Fund:

 

15-6380-571005-A Housing Division $ 25,000.00

15-6380-571005-B Housing Division 700,000.00

TOTAL $ 725,000.00

 

Section 6. That the Director of Neighborhoods and Housing Services Department or his designee is authorized to enter into and execute a contract, financing agreement and loan documents in the amount of $1,890,743.00 with Oak Point Partners, LLC., to provide funds for the construction of 30 units of affordable rental housing.

 

Section 7. That the Director of Neighborhoods and Housing Services Department is designated as requisitioning authority for Account Nos. 15-2940-555316, 15-2940-575326 and 15-6380-571005.
