ORDINANCE NO. 150476

 

Declaring certain real property within the Final Plat of 2001 Main to be surplus to the needs of City; authorizing the Director of the General Services Department to convey these surplus parcels to the Tax Increment Financing Commission; and authorizing the execution of related documents. 

WHEREAS, the Council approved the 2001 Main Street Tax Increment Financing Plan and designated a redevelopment area for the property located at 2001 Main Street in Ordinance No. 140808; and

WHEREAS, the City Manager has determined on behalf of all City departments that any real property owned by the City within the boundaries of the redevelopment area is considered in excess of the needs of the City and no interest has been expressed by any City Department in retaining the parcels described below for public use; and

WHEREAS, the property owned by the City in fee simple is needed for the redevelopment of this site; and

WHEREAS, Section 99.820.1(3), RSMo, of the Real Property Tax Increment Allocation Redevelopment Act provides to the City the power to “as part of a redevelopment project…convey, lease, mortgage, or dispose of land and other property, real or personal, or rights or interests therein,,, all in the manner and at such price the municipality or the commission determines is reasonably necessary to achieve the objectives of the redevelopment plan”; and

 

WHEREAS, the City wishes to cooperate in the redevelopment of this site by conveying any fee interests that it has in the property to the TIF Commission; NOW, THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds and determines that any City fee simple interests in the following described properties are surplus to the needs of the City:

 

Tract 3: The South 10 feet of Lot 13, all of Lots 14, 15, 16, 17 and 18 EXCEPT that part in Main Street, Union Station Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof as recorded in Plat Book B-16, Pages 1 and 2.

 

Tract 5: All of Lots 30, 31, 32, 33, 34, 35, 36, 37 and 38, Union Station Addition, a subdivision in Kansas City, Jackson County, Missouri according to the recorded plat thereof as recorded in Plat Book B-16, Pages 1 and 2.

 


Section 2. That the Director of the General Services Department is hereby authorized to transfer the City’s interests in each of the properties listed above to the Tax Increment Financing Commission for the above-described purposes and said Director is further authorized to execute any real estate or other documents needed to effectuate the transactions noted herein.
