COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 061237

 

Approving a preliminary community unit project plan in District R-1a on a 90 acre tract of land generally located on the west side of N.E. Reinking Road about one-half mile north of N.E. 96th Street. (13540-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a preliminary community unit project in District R-1a (One-Family Dwellings, Medium Density) on a 90 acre tract of land generally located on the west side of N.E. Reinking Road about one-half mile north of N.E. 96th Street, and more specifically described as follows:

 

The SE 1/4 of the NW 1/4, the E 1/2 of the SW 1/4 of the NW 1/4, and the North 30 Acres of the E 1/2 of the SW 1/4 of Section 33, Township 52, Range 32, in Kansas City, Clay County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer dedicate additional right of way for N.E. Reinking Road as required by Development Services so as to insure 30 feet of right of way as measured from the centerline of N.E. Reinking Road.

 

3. That the developer improve the western one-half of N.E. Reinking Road to collector street standards as required by Development Services, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

4. That N.E. Reinking Road from the south plan boundary south to N.E. 96th Street, and N.E. 96th Street from N.E. Reinking Road west to I-435 be improved to a minimum paved width of 22 feet as required by Development Services (or construction contract(s) be entered into for the improvements) prior to approval of the first final plat.

 

5. That the developer submit a macro "overall" storm drainage study for the entire development to Development Services for approval at the time the first plat is submitted, with a micro "detailed" storm drainage study to be submitted for each phase at the time of final platting, and that the developer construct any necessary improvements as required by Development Services.

 

6. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

7. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

8. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

9. That the developer design and construct all interior streets to City standards as required by Development Services, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

10. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities.

 

11. That temporary off-site cul-de-sacs be constructed, as required by Development Services, at three locations along the west line of the project as shown on the development plan.

 

12. That adequate sight distance be provided for each street connection to N.E. Reinking Road as required by Development Services.

 

13. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

14. That the developer extend water mains as required by the Water Services Department.

 

15. That the developer secure the approval of the Missouri Highways and Transportation Department for any work within State right of way.

 

16. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

17. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

18. That the developer obtain floodplain certificate(s) from Development Services prior to beginning any construction activities within the floodplain.

 

19. That the developer provide restrictions to prohibit building permits from being issued for lots on which temporary on-site cul-de-sacs are located until the permanent street connections have been constructed and that the restriction be placed on the final plats.

 

20. That the limits of the 100-year floodplain and the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year floodplain area be shown on the final plat.

 

21. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

22. That the developer receive the approval of the Board of Zoning Adjustment for any necessary front and rear yard setback variances for the townhomes.

 

23. That the developer secure approval of the Street Naming Committee for all street names prior to submittal of the first final plat, and that the developer submit a copy of the approved street name plan as part of each final plat submittal to the Department of City Development.

 

24. That the developer submit a street tree planting plan prior to or concurrent with each final plat submittal, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

25. That the developer submit a final plan to the City Plan Commission for approval for landscaping tracts, detention areas, open space and townhomes, including detailed information on landscaping, signage (including elevations), lighting and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
