Approving a Community Unit Project on approximately a
40.6 acre tract of land generally located at the southwest corner of Missouri
Highway 350 and Bannister Road. (11945-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on
approximately a 40.6 acre tract of land generally located at the southwest
corner of Missouri Highway 350 and Bannister Road, and more specifically
described as follows:
A tract of land lying in the Southeast Quarter of
Section 26, Township 48, Range 32 West, Kansas City, Jackson County,
Missouri, being more particularly described as follows: Commencing at the
southeast corner of the Southeast Quarter of said Section 26; thence along
the south line of the East-Half of the Southeast Quarter of said Section
26, North 86 12'34" West, a distance of 660.00 feet to the point of
beginning; thence North 86 12'34" West along said south line a distance
of 691.45 feet to the southeast corner of the West-Half of said Southeast
Quarter; thence North 3 23'45" East along the east line of the
West-Half of said Southeast Quarter, a distance of 35 feet to the
centerline of Kansas City, Independence, and Lee's Summit Railroad survey;
thence along said centerline on a curve to the right having a radius of
955.40 feet (a chord bearing of North 25 20'06" West and a chord
length of 149.01 feet) a distance of 149.16 feet (Deed = 150 feet); thence
North 20 26'06" West (Deed = North 23 West) along said centerline a
distance of 160.10 feet (Deed = 160 feet); thence along said centerline on
a curve to the left having a radius of 633.70 feet (Deed = 716.80 feet) (a
chord bearing of North 43 34'27" West an a chord length of 564.08
feet) a distance of 584.59 feet (Deed = 580 feet); thence North 73 17'26"
West (Deed = North 69 20' West) a distance of 143.46 feet (Deed = 160
feet); thence North 6 55' East (Deed = North 5 East) a distance of 602
feet to the south right of way line of Bannister Road as now established
(40 feet from the centerline thereof); thence along said south right of
way line on a curve to the right having a radius of 1106.28 feet (a chord
bearing of North 87 16'20" East, and a chord length of 552.38 feet) a
distance of 558.28 feet to a point of curve; thence continuing along said
south right of way line, South 78 16'15" East a distance of 159.87
feet; thence continuing along said south right of way line, South 78
26'00" East, a distance of 677.13 feet to a point on the westerly
right of way line of U.S. Highway No. 350; thence South 61 44'03"
East along said right of way line of U.S. Highway No. 350, a distance of
104.40 feet; thence South 78 26' East along said right of way line a
distance of 173.60 feet; thence South 58 19'03" East along said right
of way line a distance of 105.44 feet; thence South 03 37'55" East
along said right of way line a distance of 115.04 feet; thence South 01
59'04" East along said right of way line a distance of 122.01 feet;
thence South 28 37'55" East along said right of way line, a distance
of 121.58 feet; thence South 63 42'14" East along said right of way
line a distance of 130.90 feet; thence South 47 55'10" East along
said right of way line a distance of 73.32 feet to the east line of said
Southeast Quarter; thence leaving said right of way South 03 34' West
along said east line a distance of 65.73 feet to a point 660 feet north of the
southeast corner of said Section; thence North 86 12'34" West
parallel with the south line of the East-Half of the Southeast Quarter a
distance of 660 feet; thence South 3 34' West parallel with the east line
of said Southeast Quarter a distance of 660 feet to the point of
beginning. 40.646 acres.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first final plat is submitted and that the
developer make any necessary improvements as
required by the City Engineer's
Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer improve the south half of
Bannister Road to primary arterial street standards as required by
the Department of Public Works.
5. That the developer dedicate additional right of
way for Bannister Road as required by the Department of Public Works
so as to provide a total of 50 feet of right of way as
measured from the centerline of Bannister Road.
6. That the developer install hard surface roads
and provide for fire protection as required by the Fire Department
prior to construction beyond foundations.
7. That the developer extend water mains as
required by the Water Services Department.
8. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
9. That the developer submit a street name sign
plan to the Street Naming Committee for approval prior to the
submittal of the first final plat.
10. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works.
11. That the developer receive the approval of the
Missouri Highway and Transportation Department for the access to
Bannister Road for the easternmost public street as
shown on the attached preliminary plan.
12. That the developer provide adequate site
distance for the two public street connections to Bannister Road as
required by the Department of Public Works.
13. That the developer receive approval of the
Missouri Highway and Transportation Department for any work in State
right of way.
14. That the developer receive the approval of the
Board of Zoning Adjustment for any subdivision identification signs.
15. That the developer submit a street tree
planting plan as part of the final plat and secure the approval of
the City Forester for street trees planted on right of way in
front of residential lots. The plan shall
include size, type, species and placement of
trees.
16. That the developer submit covenants, conditions
and restrictions with the final plat to the Law Department for
approval for the maintenance of private open space and
detention areas.
17. That the developer submit a final plan to the
City Plan Commission for approval, including detailed information on
landscaping.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 970194, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
