RESOLUTION NO. 031325

 

Amending the South Central Area Plan in an area generally bounded by Volker/47th Street on the north, 63rd Street on the south, Prospect Avenue on the east and Oak Street on the west, by modifying the Land Use Plan and Map to be consistent with the Blue Hills Neighborhood Plan. (249-S-7)

 

WHEREAS, on March 21, 1980, the City Council by adoption of Resolution No. 51319 adopted the South Central Area Plan being the plan for development and redevelopment of that area bounded by Volker/47th Street on the north, 63rd Street on the south, Prospect Avenue on the east and Oak Street on the west; and

WHEREAS, said South Central Area Plan was amended on June 18, 1989, through the adoption of Committee Substitute for Resolution No. 63221; was again amended on November 30, 1989, through the adoption of Resolution No. 64742; was amended on November 6, 1997, through the adoption of Resolution No. 971077; was amended on February 11, 1998, through the adoption of Resolution No. 981498; was amended on March 18, 1999, through the adoption of Resolution No. 990137; was amended on July 12, 2001, through the adoption of Resolution No. 010947; and was further amended on November 7, 2002, through the adoption of Resolution No. 021247; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the South Central Area Plan as it affects the following areas:

 

a. The west side of Prospect Avenue from 59th Street on the south to Bruce R. Watkins Drive on the north from commercial uses between 62nd Street and 63rd Street, between 58th Street and 60th street, and north of 53rd Street and medium density residential (9-28 units per acre) to medium density residential uses with mixed-use nodes at 59th Street and 55th;

 

b. The area bounded by 53rd Street on the north, Highland Avenue on the eats, 56th Street on the south and Wayne Avenue on the west from medium density residential to low density residential (1-8 units per acre); and

 

c. The area bounded by 54th Street on the north, Garfield Avenue on the west, 59th Street on the south and the rear property line of properties on the west side of Prospect Avenue from medium density residential and low density residential all to low density residential; and

 

d. The area bounded by Swope Parkway on the north, Woodland Avenue on the east, Flora Avenue on the west and 49th Street on the south from public/semi-public, low density residential and medium density residential all to public/semi-public; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on November 3, 2003; and


WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on November 18, 2003; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on November 18, 2003, recommend approval of the proposed amendment to the South Central Area Plan; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That the South Central Area Plan is hereby amended for the following areas:

 

a. The west side of Prospect Avenue from 59th Street on the south to Bruce R. Watkins Drive on the north from commercial uses between 62nd Street and 63rd Street, between 58th Street and 60th street, and north of 53rd Street and medium density residential to medium density residential uses with mixed-use nodes at 59th Street and 55th;

 

b. The area bounded by 53rd Street on the north, Highland Avenue on the eats, 56th Street on the south and Wayne Avenue on the west from medium density residential to low density residential; and

 

c. The area bounded by 54th Street on the north, Garfield Avenue on the west, 59th Street on the south and the rear property line of properties on the west side of Prospect Avenue from medium density residential and low density residential all to low density residential; and

 

d. The area bounded by Swope Parkway on the north, Woodland Avenue on the east, Flora Avenue on the west and 49th Street on the south from public/semi-public, low density residential and medium density residential all to public/semi-public.

 

A copy of said amendment to the South Central Area Plan is attached hereto as Exhibit "A" and incorporated herein by reference.

Section B. That the amendment to the South Central Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
