RESOLUTION NO. 170486
Amending
the Proposed Land Use Plan within the Midtown/Plaza Area Plan by changing the
recommended land use on a 4.1 acre tract of land generally located east of Mill
Street, north of Westport Road, and west of Pennsylvania Avenue from Mixed Use
Community to Commercial. (132-S-46)
WHEREAS,
on January 7, 2016, the City Council adopted Resolution 150899 approving the Midtown/Plaza Area Plan as a guide for
the future development, redevelopment, and public investment within the area
generally bounded by 31st Street on the north, the city limits of Kansas City,
Missouri on the west, 55th Street on the south and the Paseo on the east;
removing the Future Land Use Map and Bowl Concept Recommendations in the Plaza
Westport Neighborhood Plan and replacing them with references to the
Midtown/Plaza Area Plan; amending the South Central Area Plan and the Country
Club Area Plan by deleting the portion of the plans covered by the
Midtown/Plaza Area Plan; and repealing and replacing the Troost Corridor Action
Plan, the Main Street Corridor Land Use and Development Plan, the Troostwood
Neighborhood Plan, the Brush Creek Corridor Land Use and Development Plan, the
Plaza Urban Design and Development Plan, the South Volker Neighborhood Plan,
the Westport Planning Area Plan, the Oak Park North Area Plan, and the Oak Park
South Area Plan with the Midtown / Plaza Area Plan (727-S, 611-S -5, 249-S-14,
260-S-12, 619-S-1, 581-S-10, 547-S-1, 532-S-3, 225-S-27, 400-S-1, 132-S-45,
385-S-18, 219-S-18); and
WHEREAS, due to certain changes, it
is desirable to modify certain components of the Midtown / Plaza Area
Plan by an amendment to the Proposed Land Use Plan as
it affects a 4.1 acre tract generally located east of Mill Street, north
of Westport Road, and west of Pennsylvania Avenue
from Mixed Use Community to Commercial; and
WHEREAS, public notice of a hearing
before the City Plan Commission was published on May 22, 2017, as required by
law; and
WHEREAS, the
City Plan Commission considered such amendment to the Proposed Land Use Plan on
June 6, 2017; and
WHEREAS, after all interested persons were given an
opportunity to present testimony, the City Plan Commission did on June 6, 2017,
recommend approval of the proposed amendment to the Midtown/Plaza Area
Plan; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF KANSAS CITY:
Section A. That the Proposed Land Use Plan within the Midtown/Plaza
Area Plan is hereby amended for a 4.1 acre tract generally
located east of Mill Street, north of Westport Road, and west of Pennsylvania
Avenue from Mixed Use Community to Commercial.
Section B. That the Council finds and declares that before
taking any action on the proposed area plan amendment hereinabove, all public
notices have been given and hearings have been held as required by law.
