ORDINANCE NO. 180547

 

Estimating revenue in the amount of $1,600,000.00 in the Capital Improvements Fund; appropriating $1,728,500.00 to the N.E. Parvin Road Reconstruction Project, from Interstate 435 to N. Skiles Avenue, and $335,197.38 to the Revolving Clay County Reserve Project; authorizing a construction contract with Emery Sapp & Sons, Inc., in the amount of $1,728,410.00 for street improvements on the Project; designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, on February 5, 2015, the City Council passed Committee Substitute for Ordinance No. 150015 providing $757,543.00 to the N.E. Parvin Road reconstruction project from the Searcy Creek Tax Increment Financing Plan for the design and construction of the project; and

 

WHEREAS, on December 20, 2012, the City Council passed Ordinance No. 121056 appropriating Fiscal Years 2011-2014 of the Clay County property tax proceeds to Project No. 89008112 – Street Improvements on N. Brighton from Missouri Highway 210 to Parvin Road – Fed. No. STP-3400(422); and

WHEREAS, available funds from the City’s share of Clay County’s property tax proceeds for Fiscal Years 2011-2018 collected were $463,697.38, and funds for Fiscal Years 2019 and 2020 are estimated to be $800,000.00 per year, which can be used for improvements to the N.E. Parvin Road reconstruction project; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the revenue in the following account of the Capital Improvements Fund is hereby estimated in the amount:

 

19-3090-895911-480190-89008266 Road & Bridge Tax-Clay Co $1,600,000.00

Section 2. That $2,063,697.38 is hereby appropriated from the unappropriated Fund Balance of the Capital Improvements Fund to the following accounts:

 

19-3090-895911-B-89008266 N.E. Parvin Road Reconstruction $1,728,500.00

19-3090-895911-B-89CLAY02 Revolving Clay County Reserve 335,197.38

TOTAL $2,063,697.38

 

Section 3. That the Director of Public Works is hereby authorized to execute, on behalf of the City, a $1,728,409.62 contract with Emery Sapp & Sons, Inc., for Project No. 89008266 – N.E. Parvin Road Reconstruction from I-435 to N. Skiles Avenue. A copy of the contract is on file in the Public Works Department.

 

Section 4. That the Director of Public Works is hereby designated as requisitioning authority for Account No. 19-3090-895911.

 

Section 5. That the Director of Finance is authorized to calculate and re-estimate

Fiscal Year 2018-2019 uncollected revenues to the appropriate revenue accounts in Fiscal Year 2019-2020.

 

Section 6. That the Director of Finance is authorized to appropriate Fiscal Year 2018-2019 unexpended and unencumbered balances of all appropriations to the same accounts in Fiscal Year 2019-2020 which are necessary to carry out the terms and conditions of the respective agreements previously awarded.

 

Section 7. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
