ORDINANCE NO. 980179

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0123, rezoning an area of approximately 29.26 acres generally located at the southwest corner of N.E. 95th Terrace and N. Oak Trafficway from District RA (Agricultural) to District R-4 (Low-Apartments). (12009-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0123, rezoning an area of approximately 29.26 acres generally located at the southwest corner of N.E. 95th Terrace and N. Oak Trafficway from District RA (Agricultural) to District R-4 (Low Apartments), said section to read as follows:

 

Section 80-11A0123. That an area legally described as:

 

A tract of land in the East One-Half of the Northwest Quarter of Section 2, Township 51, Range 33, Kansas City, Clay County, Missouri, being described as follows: Beginning at a point on the west line of the East One-Half of the Northwest Quarter of said Section 2, said point being 395.9 feet north of the southwest corner thereof; thence North 026'47" East, along said west line, 1541.20 feet to a point on the centerline of a public road; thence South 5154'13" East, along said centerline, 109.67 feet; thence South 5631'13" East, along said centerline, 77.00 feet; thence South 6319'13" East, along said centerline, 74.00 feet; thence South 6542'13" East, along said centerline, 73.00 feet; thence South 7009'13" East, along said centerline, 77.00 feet; thence South 7419'13" East, along said centerline, 83.70 feet; thence South 7626'26" East, along said centerline, 200.00 feet; thence South 7619'13" East, along said centerline, 684.36 feet to its intersection with the centerline of Missouri State Highway No. 169; thence South 021'52" West, along said centerline, 315.57 feet; thence North 8935'31" West, 148.13 feet; thence southwesterly along a curve to the left, tangent to the last described course, having a radius of 254.00 feet, an arc distance of 130.64 feet; thence South 6056'23" West, 231.92 feet; thence southwesterly, along a curve to the right, having an initial tangent bearing of South 5832'45" West, a radius of 350.00 feet, an arc distance of 61.44 feet; thence South 0103'35" West, 354.38 feet; thence South 1703'14" East, 206.96 feet to a point on the northerly right of way line of Missouri Route 152, as now exists; thence South 6233'54" West, along said northerly right of way line, 162.69 feet; thence North 8943'15" West, 684.36 feet to the point of beginning. Containing 29.26 acres, more or less.

 

is hereby rezoned from District RA (Agricultural) to District R-4 (Low Apartments), all as shown outlined on a map marked Section 80-11A0123, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
