ORDINANCE NO. 970319

 

Repealing Ordinance No. 961160, passed on September 12, 1996, and authorizing execution of a $14,200,000.00 development agreement with the Housing Development Corporation and Information Center, Inc., and the Westside Industrial Park, L.L.C., for the development and construction of the Westside Industrial Park Project.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 961160, passed by the City Council on September 12, 1996, is hereby repealed and the authority to execute the agreement approved therein is hereby rescinded.

 

Section 2. That the Director of the Department of Housing and Community Development is hereby authorized to execute a development agreement with the Housing Development Corporation and Information Center, Inc., and the Westside Industrial Park, L.L.C., in the amount of $14,200,000.00, for the development and construction of the Westside Industrial Park Project to be paid from funds previously appropriated to Account Nos. 96-254-055-2428-B, Westside Business Park - HUD EDI ($7,100,000.00) and 96-250-055-2428-B, Westside Business Park - HUD EDI ($7,100,000.00). A copy of the agreement, in substantial form, is attached hereto and is hereby approved.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
