SUBSTITUTE FOR ORDINANCE NO. 050683
Rezoning an area of
approximately 4.1 acres generally located south of N.E. 43rd Street
between N. Bellefontaine Avenue and N. Walrond Avenue from District R-1b to
District URD, and approving a development plan for the same. (13369-URD)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code
of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning
Ordinance, is hereby amended by enacting a new section to be known as Section
80-11A0639, rezoning an area of approximately 4.1 acres generally located south
of N.E. 43rd Street between N. Bellefontaine Avenue and N. Walrond
Avenue from District R-1b (One Family Dwellings) to District URD (Urban
Redevelopment District), said section to read as follows:
Section 80-11A0639. That an area
legally described as:
Tracts (or Lots) 7, 8, 11 and 12, Jeffries Heights, a
subdivision in Kansas City, Clay County, Missouri, according to recorded plat
thereof (except the west 5 feet of Lots 7 and 8 and the east 5 feet of Lots 11
and 12 of said Jeffries Heights, dedicated to street right-of-way.
More particularly described as follows:
Commencing at the northwest corner of Lot 8, a
subdivision in Kansas City, Clay County, Missouri, according to recorded plat
thereof; thence S 881106E, along the north line of said Lot 8, a distance of
5.00 feet, to the point of beginning; thence continuing S 881106E along the
north lines of Lots 8 and 11, a distance of 408.40 feet; thence S 005946W,
parallel to the existing west right-of-way line of North Walrond Avenue, a
distance of 418.01 feet, to a point on the south line of Lot 12; thence N 881105W,
along the south lines of Lots 12 and 7, a distance of 408.25 feet; thence N
005832E, parallel to the existing east right-of-way line of North
Bellefontaine Avenue, a distance 418.01 feet to the point of beginning, said
tract containing 170,665 square feet or 3.92 acres more or less.
is hereby rezoned from Districts
R-1b (One Family Dwellings) to District URD (Urban Redevelopment District), all
as shown outlined on a map marked Section 80-11A0639, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1.
That the developer submit a macro/micro storm drainage study to
Development Services for approval for the entire development prior to approval
for buildings, and that the developer construct any improvements as required by
Development Services.
2.
That the developer dedicate additional right of way by general warranty
deed for a local street as required by Development Services so as to provide a
minimum of 25 feet of right of way as measured from the centerline of N. Bellefontaine Avenue.
3.
That the developer dedicate additional right of way by general warranty
deed for a local street as required by Development Services so as to provide a
minimum of 25 feet of right of way as measured from the centerline of N. Walrond Avenue.
4.
That the developer shall subordinate to the City all private interest in
the area of any right-of-way dedication as required by Development Services,
and that the developer shall be responsible for all costs associated with
subordination activities.
5.
That the developer submit plans for grading, siltation, and erosion
control to Development Services for approval and permitting prior to beginning
any construction activities.
6.
That the developer secure a land disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area exceeds one acre.
7.
That the developer extend sanitary sewers to ensure individual service
is provided to all proposed lots and determine adequacy as required by the
Development Services.
8.
That the developer provide a storm water conveyance system to serve all
proposed lots within the development and determine adequacy as required by
Development Services.
9.
That the developer extend water mains as required by the Water Services
Department at the time of the submittal of the final plat.
10.
That the developer provide for fire protection as required by the Fire
Department.
11.
That the developer submit a site plan to the Director of the Department
of City Development for approval prior to the issuance of a building permit.
The site plan shall include information regarding: property uses, setback
distances, lighting, landscaping and architectural characteristics, berms,
trees and plantings around and within the parking lots; show proposed
pedestrian circulation; and include elevation drawings of buildings and
signage.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
