Amending a previously approved development plan in
District PD/R-6 (Planned District/High Apartments, Provisional) on
approximately a 10.53 acre tract of land generally bounded by 49th Street on
the north, 50th Street on the south, Wornall Road on the west and the east side
of Wyandotte Street on the east, to delete therefrom an approximately .628 acre
tract of land. (9549-PD-10)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved development plan in District PD/R-6 (Planned District/High Apartments,
Provisional) on approximately a 10.53 acre tract of land generally bounded by
49th Street on the north, 50th Street on the south, Wornall Road on the west
and the east side of Wyandotte Street on the east, and more specifically
described as follows:
This is a resurvey and subdivision of all of Lots 6
through 11, both inclusive, parts of Lots 12 and 24 and all of Lots 13
through 23, both inclusive, Block E; all of Lots 1 through 11, both
inclusive, parts of Lots 12 and 24 and all of Lots 13 through 23, both
inclusive, Block F; and all of Lots 1 through 12, both inclusive, Block G,
Bismark Place, a subdivision, according to the recorded plat, together with
portions of 49th Street, 50th Street, Wornall Road, Central Street,
Wyandotte Street as said streets and road are now established and other
lands, all in the West Half of the Southwest Quarter of Section 29,
Township 49, Range 33, in Kansas City, Jackson County, Missouri, being
more particularly described as follows: Beginning at the southwest corner
of Lot 5, Block E of said Bismark Place, being also a point on the east
right of way line of Wornall Road, as now established; thence west 30 feet to
a point on the west line of Southwest Quarter of said Southwest Quarter;
thence South 2 34'38" West along said west line to a point of
intersection with the centerline of said 50th Street; thence South 87
04'13" East along said centerline, 661.20 feet to a jog in said
centerline and a point on the centerline of said Wyandotte Street produced
south; thence South 2 36'20" West along said centerline and along said
jog, 21.43 feet (22.00 feet plat); thence South 87 07'13" East along
the centerline of said 50th Street, 165.77 feet to a point of intersection
with the prolongation south of the east line of Lots 1 through 12 in said
Block G; thence North 2 32'41" East along said prolongation and along
the east line of said Lot 12, a distance of 30.12 feet to a point which is
5.00 feet north of the southeast corner thereof, said point being also on
the west line of Block 2, Board of Trade Center, Blocks 1, 2 and 3, a
subdivision in said city, county and state, according to the recorded plat
thereof, being also a point which is 0.12 feet north of the southwest
corner thereof; thence continuing North 2 32'41" East along said west
line and along the east line of Lots 12 through 3 in said Block G, a
distance of 495.70 feet to the southeast corner of the north 25 feet of Lot
3, Block G of said Bismark Place; thence North 87 17'55" West along
the south line of the north 25 feet of said Lot 3, a distance of 134.17
feet to a point on the west line of said Lot 3, being also a point on the
east right of way line of Wyandotte Street, as now established; thence
North 2 36'20" East along the west line of Lots 3 and 2 of said Block
G and along said east right of way line, a distance of 45 feet; thence
South 87 17'55" East and along the north line of the south 20 feet of
said Lot 2, a distance of 134.66 feet to a point on the east line of Lot
2, Block G of said Bismark Place; thence North 2 32'41" East along
the east line of said Lot 2 and 1, 80 feet to a point which is 3 feet
north of the northeast corner of Lot 1 in said Block G, being also the
northwest corner of said Block 2, Board of Trade; thence continuing North 2
32'41" East, 40.50 feet; thence North 87 17'55" West along the
centerline of 49th Street, as now established, 133.65 feet to a point of
curvature; thence northwesterly along said centerline and along a curve to
the right, tangent to the last described course having a radius of 649.90
feet, and a central angle of 8 09'13", an arc distance of 92.49 feet;
thence North 79 08'42" West along said centerline, tangent to the last
described curve, 182.99 feet to a point of curvature; thence
northwesterly, westerly and southwesterly along said centerline and along
a curve to the left, tangent to the last described course, having a radius
of 159.92 feet and a central angle of 22 14'49", an arc distance of
62.09 feet; thence South 78 36'29" West along said centerline,
tangent to the last described curve, a distance of 146.97 feet to a point
of curvature; thence southwesterly along a curve to the right, tangent to
the last described course, having a radius of 400 feet, and a central
angle of 7 12'40", an arc distance of 50.93 feet to a point of
intersection with the prolongation north of the east line of Lots 1
through 5 of said Block E; thence South 2 32'21" West along said
prolongation, 27.84 feet to the northeast corner of said Lot 1; thence
continuing South 2 32'21" West along the east line of said Lots 1
through 5, Block E, a distance of 249.34 feet (250.00 feet plat) to the
southeast corner of said Lot 5; thence North 87 17'06" West along the
south line of said Lot 5, 135.52 feet to the point of beginning.
is hereby amended by deleting therefrom .628 acres, more
specifically described as follows:
All of Lots 11, 12, 23 and 24, Bismark Place, a subdivision
in Kansas City, Jackson County, Missouri.
Such amendment is hereby approved, subject to the
following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval for the entire development
when the first plat is submitted and that the
developer make any improvements as required by
the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer petition and pursue the
vacation of public streets as determined necessary by the City
Engineer's Office.
5. That the developer widen Wyandotte Street to
collector street standards, 36 feet back to back of curb, from 50th
Street to 51st Street as required by the Department of
Public Works.
6. That the developer construction 25 to 30 foot
curb radii in the southeast and northeast quadrants of the
intersection of 51st Street and Wornall Road as required
by the Department of Public Works.
7. That the developer widen the east approach of
51st Street to Wornall Road to provide a minimum 100 foot long left
turn lane as required by the Department of Public
Works.
8. That the developer provide adequate site
distance at the parking garage accesses of all public streets as
required by the Department of Public Works.
9. That the developer straighten the jog in 50th
Street to provide better through movement across Wyandotte Street as
required by the Department of Public Works.
10. That the developer improve 50th Street to
collector street standards from Wornall Road to the widened section
on the south side of the Board of Trade, lying east of the
subject property, as required by the Department
of Public Works.
11. That the developer dedicate additional right of
way along the south side of 49th Street for the frontage of the
subject property as shown on the development plan as required
by the Department of Public Works.
12. That the developer construct sidewalks along
all street frontage where sidewalks do not now exist as required by
the Department of Public Works.
13. That the developer contribute to the Plaza Area
Study Improvement Fund based on a rate of $225.00 per unit to be used
for the improvement of 51st Street east of the
widening by the developer of the intersections
of Wornall Road and 51st Street as
required herein; provided that the developer
shall be given credit for the actual cost
of any improvement to 51st Street and Wyandotte
Street.
14. That the developer explore alternative
redesigns to the intersection of 49th Street and Wornall Road with
the City, including signalization, to address the present poor
geometrics and the impact of additional traffic
from the development on the subject
property.
15. That the developer secure the approval of the
Street Naming Committee for all proposed street names.
16. That the developer post the private street as
such as required by the Department of Public Works.
17. That the developer prohibit any construction in
excess of the height restrictions of the Kansas City Downtown Airport
Height Zoning Restrictions.
18. That the developer comply with all parking
setback requirements for District R-6 and provide parking on the
basis of 1 1/2 spaces per unit.
19. That the developer undertake all utility
relocation or utility extension at its cost.
20. That the developer limit the development to 62
units per acre.
21. That the developer pay money in lieu of
parkland dedication in satisfaction of Section 66-128 of the
Subdivision Regulations with a maximum number of units to be 622.
22. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 970047, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
