COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 950391
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2442, rezoning an area generally located north of
Barry Road, east of Green Hills Road and south of proposed M-152 Highway from
District GP-7 (Agricultural and Low Density Residential Uses) to District GP-5
(Medium Density, Residential Uses), and approving a development plan for the

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby
amended by enacting a new section to be known as Section 65.010A2442, rezoning
an area generally located north of Barry Road, east of Green Hills Road and
south of proposed M-152 Highway from District GP-7 (Agricultural and Low
Density Residential Uses) to District GP-5 (Medium Density, Residential Uses),
said section to read as follows:
Section 65.010A2442. That an area legally described
as:
All that part of the Northeast Quarter of Section 8,
and all that part of the Northwest Quarter of Section 9, all being in Township
51, Range 33, Kansas City, Platte County, Missouri, being bounded and
described as follows: Beginning at the northwest corner of the Northwest
Quarter of said Section 9; thence South 8922'56" East, along the
north line of said Northwest Quarter 1257.23 feet to a point on the
westerly right of way line of Line Creek Parkway, as now established; thence
South 047'57" West, along said westerly line, 107.34 feet; thence
southerly along said westerly line, on a curve to the right, tangent to
the last described course, having a radius of 1144.60 feet, an arc
distance of 216.38 feet; thence South 1137'51" West, along said
westerly line, 250.00 feet; thence southerly along said westerly line, on
a curve to the left, tangent to the last described course, having a radius of
1307.45 feet, an arc distance of 136.08 feet; thence South 540'03"
West, along said westerly line, 321.87 feet; thence southerly, along said
westerly line, on a curve to the right, tangent to the last described
course, having a radius of 1709.66 feet, an arc distance of 514.84 feet;
thence South 2255'17" West, along said westerly line, 275.00 feet;
thence southerly on a curve to the left, tangent to the last described course,
having a radius of 1396.00 feet, an arc distance of 552.81 feet; thence
South 013'57" West, along said westerly line, 233.25 feet to a point
on the north right of way line of N.W. Barry Road, as now established;
thence North 8929'01" West, along said north line, 716.15 feet;
thence North 030'59" East, 236.30 feet; thence northerly, on a curve
to the left, tangent to the last described course, having a radius of
720.00 feet, an arc distance of 236.90 feet; thence northerly, on a curve
to the right, having a common tangent with the last described course, a
radius of 1280.00 feet, an arc distance of 141.96 feet; thence North
8936'18" West, 676.49 feet; thence North 022'00" East, 1952.33
feet to a point on the north line of the Northeast Quarter of said Section
8; thence South 8854'53" East, along said north line, 667.00 feet to
the point of beginning. Containing 89.77 acres, more or less.
is hereby rezoned from District GP-7 (Agricultural and
Low Density Residential Uses) to District GP-5 (Medium Density, Residential
Uses), all as shown outlined on a map marked Section 65.010A2442, which is
attached hereto and made a part hereof, and which is hereby adopted as a part
of an amendment to the zoning maps constituting a part of said chapter and as
an amendment to Section 65.010 thereof.
Section B. That a development plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office.
3. That the developer relocate or remove any lots
if the lots are determined to be substantially located within the 70
dBa noise level as shown on the MHTD maps.
4. That the developer construct temporary
cul-de-sacs as required for each phase and construct off-site
cul-de-sacs as required.
5. That the developer receive the approval of the
Street Naming Committee for all street names.
6. That the developer install streetlights as
required.
7. That the developer extend water mains as
required by the Water Department.
8. That the developer extend sanitary sewers as
required.
9. That the developer grant a Noise and Aviation
Easement to the City.
10. That the developer construct two connections to
Line Creek Parkway including the medium crossings; provided that the
first connection shall be with Phase I of the
development plan and shall be permitted prior
to the approval of the final plat for
Phase II. The second connection shall be with
Phase III of the development plan and
shall be permitted prior to the recording of
the final plat for Phase III.
11. That the developer enter into a cooperative
agreement for the improvement of Line Creek Parkway to contribute
$20,000.00 for landscaping and $49,780.00 for
streetlights along Line Creek Parkway. A
proportionate amount shall be contributed
prior to the recording of each plat based on
the abutting length of the plat to Line
Creek Parkway as compared to the total length
of Line Creek Parkway.
12. That the developer secure a land disturbance permit
from the Missouri Department of Natural Resources.
13. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
A copy of said development plan is on file in the office
of the City Clerk under Document No. 950391, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
