COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030523

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0480, rezoning an area of approximately 82 acres generally bounded by 39th Street on the north, Gillham Road and 43rd Street on the south, Kenwood Avenue on the west and Troost Avenue on the east from Districts R-2a (Two-Family Dwellings, Low Density), R-2b (Two-Family Dwellings) and R-4 (Low Apartments) to District R-2a (Two-Family Dwellings, Low Density).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0480, rezoning an area of approximately 82 acres generally bounded by 39th Street on the north, Gillham Road and 43rd Street on the south, Kenwood Avenue on the west and Troost Avenue on the east from Districts R-2a (Two-Family Dwellings, Low Density), R-2b (Two-Family Dwellings) and R-4 (Low Apartments) to District R-2a (Two-Family Dwellings, Low Density), said section to read as follows:

 

Section 80-11A0480. That an area legally described as:

 

Lots 1 through 23, inclusive, except that portion in right of way, and Lots 26 through 40, inclusive, and Lots 45 through 48, inclusive, except that portion in right of way, Block 1, Vanderbilt Place; and Lots 2 through 24, inclusive, and Lots 34 through 42, inclusive, Block 8, Vanderbilt Place; and Lots 1 through 48, inclusive, Block 9, Vanderbilt Place; and Lots 1 through 48, inclusive, Block 16, Vanderbilt Place; and Lots 1 through 48, inclusive, Garlands Resurvey of Block 2 of the Subdivision of Blocks 1 & 2, Troost Highlands, and the adjacent vacated alleys; and Lots 13 through 48, inclusive, Resurvey of Block 1 of the Subdivision of Blocks 1 & 2 of Troost Highlands; and Lots 3 through 70, inclusive, and Lots 73 through 144, inclusive, Subdivision of Blocks 4, 6 & 8, Troost Highlands; and Lots 1 through 8, inclusive, Stegners Resurvey of Lot 12 of Block 4, Troost Highlands and the adjacent vacated alley; and Lots 1 through 11, inclusive, Stegners Resurvey of Lot 1 Block 5 Troost Highlands; Lots 1 through 6, inclusive, and the east 133.7 feet of the west 158.7 feet of Lot 8 and the east 133.35 feet of the west 158.35 feet of Lot 7, Block 3, Troost Highlands; and Lots 2 through 6, inclusive, and the east 131.7 feet of the west 156.7 feet of Lot 7, and the east 133.35 feet of the west 158.35 feet of Lots 8 through 12, inclusive, Block 5, Troost Highlands; and Lots 5 through 8, inclusive, Lee Smiths and Beadles Subdivision; and Lots 14 through 18, inclusive, and Lot 22, and Lots 25 through 48, inclusive, Block 7, Resurvey of Block 7, Troost Highlands; and Lot 5 except that portion platted in the plat of Gillham Court, Lot 6, the northwest 19 feet of Lot 7, and the west one-half of the vacated alley adjacent said Lot 6 and partial Lots 5 and 7, and Lots 13 through 16, inclusive, and the east of the vacated alley adjacent said Lots 13-16, Tate Park; all in Kansas City, Jackson County, Missouri.


is hereby rezoned from Districts R-2a (Two-Family Dwellings, Low Density), R-2b (Two-Family Dwellings) and R-4 (Low Apartments) to District R-2a (Two-Family Dwellings, Low Density), all as shown outlined on a map marked Section 80-11A0480, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
