COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140447

 

Amending Chapter 64, Code of Ordinances, by enacting a new Section 64-134, entitled “Private Quality Assurance & Quality Control Manager,” requiring the designation of a quality assurance and quality control manager by applicants for excavation permits; and establishing an effective date.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 64, Code of Ordinances of the City of Kansas City, Missouri, Article IV, entitled “Excavations”, is hereby amended by enacting a new Section 64-134, Private Quality Assurance & Quality Control Manager to read as follows:

 

Sec. 64-134. Private Quality Assurance & Quality Control Manager (QAM).

 

(a)                Excavations or bores underground exceeding a length of 100 feet within property, right-of-way, or easements owned by the city, require all permittees to provide the name of a Quality Assurance/Quality Control Manager (QAM) to the director.

 

(b)               The director must approve the QAM before work may commence. The QAM must contact the Public Works Department’s construction inspection office at least 24 hours in advance of any excavation to either provide contact information and notification of when pre-excavation photos will be taken by the QAM (or a designee) or to request a pre-excavation inspection of the job site with a city inspector. The existing conditions of the proposed and restored excavation area must be photo-documented. The contractor shall have a plan available that includes the equipment and materials to be used and how the infrastructure, landscaping, and facilities at the site will be restored to equal or better condition. The QAM or a designee must be present at the work site at the time backfill is being performed, and provide copies of the pre and post construction photos upon request.

 

(c)                The QAM must provide a document to the inspector certifying that all work has been completed and that the restoration meets the city’s specifications and standards. The QAM must provide to the city inspector the receipts for controlled low strength material (flowable backfill) incorporated into the restoration work. The city inspector will then inspect the site for acceptance by the city and will close out the permit if all of the city’s specifications and standards are met.

 

(d)               If the city inspector determines that the restoration does not meet the city’s specifications and standards, the city inspector will contact the QAM with a list of deficiencies that need correcting. The QAM must provide a document to the inspector certifying that all noted deficiencies have been corrected. The city inspector will then inspect the site and will close the permit if the restoration meets the city’s specifications and standards.

 

(e)                The close of the permit with the QAM does not relieve the permittee of the three year warranty period associated with excavation permits set forth in Section 64-125.

Section 2. This ordinance shall become effective on January 1, 2015.
