ORDINANCE NO. 940581
Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on a 8 1/2
acre tract of land generally located at the southwest corner of Bannister Road
and Blue Ridge Boulevard. (5879-CP-13)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan in District CP-2 (Local Planned Business Center) on a
8 1/2 acre tract of land generally located at the southwest corner of Bannister
Road and Blue Ridge Boulevard, and more specifically described as follows:
A tract of land in the Northwest 1/4 of the
Southeast 1/4 of Section 25, Township 48, Range 33, in Kansas City,
Jackson County, Missouri, being more particularly described as follows:
Beginning at the point of intersection of the north line of the South 1/2
of the Northeast 1/4 of the Northwest 1/4 of the Southeast 1/4 of
said Section with the west right of way line of Blue Ridge Boulevard as
now established; said point of beginning also being the easternmost
northeast corner of Tract "A"; HEN HOUSE PLACE, a subdivision in
Kansas City, Jackson County, Missouri; thence South 156'50"
East, along said west right of way line, a distance of 330.00 feet;
thence North 8652'12" West, a distance of 609.28 feet; thence North
235'46" East, a distance of 605.81 feet to a point on the south right
of way line of Bannister Road as now established; thence South
8646'56" East, along said south right of way line, a distance
of 577.43 feet; thence South 4225'35" East, a distance of 35.75
feet to a point on said west right of way line of Blue Ridge Boulevard;
thence South 156'50" West, along said west right of way line, a
distance of 249.99 feet to the point of beginning. Said tract of land
containing 366,423 square feet or 8.41 acres more or less.
is hereby approved, subject to the following conditions:
1. That the developer remove the existing
temporary "Price Chopper" signs located on Blue Ridge
Boulevard and
Bannister Road.
2. That the developer submit a final plan for
approval by the City Plan Commission including plans for the
reinstallation of the previously approved
landscaping.
3. That the developer construct sidewalks on Blue
Ridge Boulevard from the south property line north to the
second driveway, as shown on the preliminary
plan.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 940581, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
