COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 930300
Approving an amendment to the Budd Park Area Plan being
that part of Kansas City bounded by the Missouri-Pacific Railroad tracks on the
north, Kansas City Terminal Railway on the south, Belmont Boulevard on the east
and Prospect Avenue, south of Independence Avenue, and Chestnut Trafficway,
north of Independence Avenue, on the west.
WHEREAS, the City Development Department conducted a
study delineating the characteristics of the Budd Park Area being that part of
Kansas City bounded on the north by the Missouri-Pacific Railroad tracks, on
the south by Kansas City Terminal Railway, on the east by Belmont Boulevard,
and on the west by Prospect Avenue, south of Independence Avenue, and Chestnut
Trafficway, north of Independence Avenue; and
WHEREAS, the findings of the City Development
Department were incorporated in the Budd Park Area Plan and were adopted by
Resolution No. 47335, adopted January, 1977; and
WHEREAS, certain amendments were proposed to the
Budd Park Area Plan and approved by Resolution No. 930264 adopted April 15,
1993; and
WHEREAS, there has been cause to determine that an
amendment to the Budd Park Area Plan is appropriate for that area located on
the south side of 12th Street Terrace between Cleveland and Norton Avenues; and
WHEREAS, the City Development Department has
prepared an amendment to the Budd Park Plan reflecting proposed modifications
to such plan; and
WHEREAS, pursuant to legal notice of a public
hearing, the City Plan Commission held a public hearing on the proposed
amendment on February 16, 1993, in conformity with state and local laws; and
WHEREAS, the City Plan Commission recommends that
the City Council adopt a resolution approving an amendment to the Budd Park
Area Plan, specifically affecting that part of the area on the south side of
12th Street Terrace between Cleveland and Norton Avenues; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to the Budd Park Area
Plan, as prepared by the City Development Department and recommended for
adoption by the City Plan Commission on February 16, 1993, providing for a
modification to the land use recommendations for
that area on the south side of 12th Street Terrace between Cleveland and Norton
Avenues from light industrial use to propose low density residential use, is
hereby adopted as an amendment to such Plan. A copy of said amendment is on file
in the office of the City Clerk under Document No. 930300, and is incorporated
herein by reference.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by law have been given and had.
