ORDINANCE NO. 001060

 

Repealing Ordinance No. 000697; authorizing execution of a Termination of Lease Agreement with Midwest Terminal Warehouse; and authorizing execution of a Lease Agreement with Midwest Terminal Warehouse to commence on June 1, 2000, and terminate on December 31, 2020, for the sum of $2,600.00 per month.

 

WHEREAS, Midwest Terminal Warehouse is currently leasing space at a rental rate of $1,000.00 per month which began September 1, 1981, and will terminate December 31, 2001, located at Tract B: The west 14 feet of Lot 21, and all of Lots 22 thru 30, Block 11, Woodswether Industrial District; all Lots 19 and 20; and all that part of Lots 21 and 39 lying westerly of the southerly prolongation of the easterly line of Lot 19, except the southwesterly 60 feet of said Lot 21 measured at right angles from the southwesterly line of said Lot 21, Block 10, Woodswether Industrial District, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; and Lots 40, 41, 42 and 43, except the southerly 60 feet of said Lots 42 and 43, measured at right angles from the southwesterly lines of said lots, all in Block 10, Woodswether Industrial District, a subdivision in Kansas City, Wyandotte County, Kansas, according to the recorded plat thereof, the City shall terminate the current agreement on May 31, 2000; and

 

WHEREAS, the premises shall be used for the purpose of a public marine terminal and for ancillary and related purposes, without discrimination between carriers or cargo; and

 

WHEREAS, the agreement shall commence June 1, 2000, and the agreement shall terminate on December 31, 2020; and

 

WHEREAS, Midwest Terminal Warehouse shall pay to the City, $2,600.00 per month for the period June 1, 2000, through December 31, 2020; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 000697, passed May 25, 2000, is hereby repealed and a new ordinance is hereby enacted.

 

Section 2. That the Director of City Development is hereby authorized to execute, on behalf of the City, a Termination of Lease Agreement with Midwest Terminal Warehouse for City property located at:

 

Tract B: The west 14 feet of Lot 21, and all of Lots 22 thru 30, Block 11, Woodswether Industrial District; all Lots 19 and 20; and all that part of Lots 21 and 39 lying westerly of the southerly prolongation of the easterly line of Lot 19, except the southwesterly 60 feet of said Lot 21 measured at right angles from the southwesterly line of said Lot 21, Block 10, Woodswether Industrial District, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; and Lots 40, 41, 42 and 43, except the southerly 60 feet of said Lots 42 and 43, measured at right angles from the southwesterly lines of said lots, all in Block 10,

Section 3. That the Director of City Development is hereby authorized to execute, on behalf of the City, a Lease Agreement with Midwest Terminal Warehouse to lease property located at:

 

Tract B: The west 14 feet of Lot 21, and all of Lots 22 thru 30, Block 11, Woodswether Industrial District; all Lots 19 and 20; and all that part of Lots 21 and 39 lying westerly of the southerly prolongation of the easterly line of Lot 19, except the southwesterly 60 feet of said Lot 21 measured at right angles from the southwesterly line of said Lot 21, Block 10, Woodswether Industrial District, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; and Lots 40, 41, 42 and 43, except the southerly 60 feet of said Lots 42 and 43, measured at right angles from the southwesterly lines of said lots, all in Block 10, Woodswether Industrial District, a subdivision in Kansas City, Wyandotte County, Kansas, according to the recorded plat thereof.

 

The lease will commence on June 1, 2000, and terminate on December 31, 2020, in which Midwest Terminal Warehouse will pay to the City the sum of $2,600.00 per month. A copy of the Lease Agreement, in substantial form, is attached hereto and is hereby approved.
