COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001499, AS AMENDED

 

Approving an amendment to a previously approved Community Unit Project in District R-1b (One-Family Dwellings) on approximately a 241.47 acre tract of land generally bounded by N.W. 108th Street on the south, Highway 169 on the east, and N.W. Cookingham Drive on the north, for the purpose of deleting an approximately 48.3 acre tract of land from said Community Unit Project. (10872-CUP-12)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project in District R-1b (One-Family Dwellings) on approximately a 241.47 acre tract of land generally bounded by N.W. 108th Street on the south, Highway 169 on the east, and N.W. Cookingham Drive on the north, and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 22, and all that part of the Northeast Quarter of Section 27, all in Township 52, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: Beginning at the southwest corner of the Southeast Quarter of said Section 22; thence North 0E09'15" East along the west line of said Southeast Quarter, 1314.39 feet to the northwest corner of the south one-half of said Southeast Quarter; thence South 89E43'36" East along the north line of the south one-half of said Southeast Quarter, 198.00 feet; thence North 0E09'15" East, parallel with the west line of said Southeast Quarter, 1283.81 feet to a point on the south right of way line of Missouri State Highway Route 291, as now established; thence South 89E47'55" East along said right of way line, 622.32 feet; thence South 0E12'05" West, 595.00 feet; thence South 89E47'55" East, 1067.47 feet to a point on the westerly right of way line of N.W. is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer dedicate additional right of way for N.W. 108th Street (Shoal Creek Parkway) as required by the Board of Parks and Recreation Commissioners so as to provide a minimum of 120 feet of right of way as measured from the centerline of N.W. 108th Street (Shoal Creek Parkway).

 

10. That the developer enter into a Cooperative Agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute a total of $70,233.00 for the improvement of N.W. 108th Street (Shoal Creek Parkway).

 

11. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

12. That the developer receive the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

13. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

14. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signage.

 

15. That the developer comply with the Kansas City International Airport Height Zoning restrictions and that such restrictions be included on the final plat.

 

16. That the developer submit covenants, conditions and restrictions to the Law Department for approval for maintenance of private open spaces and any detention areas with the final plat.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 001499, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
