ORDINANCE NO. 050561

 

Approving the Valentine-Broadway (PIEA) General Development Plan for an area of approximately 2.1 acres generally bounded by Broadway Avenue on the west, Central Street on the east, a line about 150 feet north of 36th Street on the north and a line about 400 feet south of 36th Street on the south; declaring the area included in such plan to be a blighted, unsanitary or undeveloped industrial area and its redevelopment necessary. (624-S)

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or cause to be prepared the Valentine-Broadway (PIEA) General Development Plan and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the Valentine-Broadway (PIEA) General Development Plan on April 19, 2005, as evidenced by its disposition of the case and has found said plan to be conformance with the general plan for the development of the community as a whole, and;

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan and a designation of blight if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Council declares the area of approximately 2.1 acres between Broadway Avenue on the west, Central Street on the east, a line about 150 feet north of 36th Street on the north and a line about 400 feet south of 36th Street on the south, and more specifically described by tax parcel as follows:

Tract 1: Hyde Park Lots 10 & 11, Blk 7

 

Tract 2: 336 W 36th/S 60 ft lot 12, Blk 7, Hyde Park

 

Tract 3: 3600 Central, Hanover Place, Lot 13 & E Vac Alley W & Adj.

 

Tract 4: 3601 Broadway/Lots 23 & 24, also W Vac Alley E of & Adj., Hanover Place

 

Tract 5: 3604 Central, Hanover Place, Lot 14, also E Vac Alley, W of & Adj.

 

Tract 6: Sec 20-49-33 NW NW , Hanover Place, Lot 15 & N Lot 16 & E Vac Alley Ly W of & Adj & N 46 Lot 20 & all Lot 21 & S 29.25 of Lot 22 & W Vac Alley E & Adj.

 

The South of Lot 16, all of Lot 17, and the East of the vacated alley lying West of and adjoining the said South of Lot 16, all of Lot 17, HANOVER PLACE, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract 7: 3611 Broadway / N 20.75 Ft Lot 22, also W Vac Alley E of & Adj, Hanover Place

 

Tract 8: The North of Lot 16, all of Lot 15, and the East of the vacated alley lying West of the adjoining all of the above described in Hanover Place, a subdivision in Kansas City, Jackson County, Missouri; also the North 46 of Lot 20, all of Lot 21 and the South 29.25 of Lot 22, and the West of the vacated alley lying East of and adjoining the above described in Hanover Place.

 

Tract 9: All of Lots 13 and 14, Block 60, PLAT OF BLOCKS 59 and 60, HYDE PARK a subdivision in Kansas City, Jackson County, Missouri, ALSO all of Lot 19 and the South 4 feet of Lot 20 and the West of the vacated alley lying East of and adjoining said Lot 19 and said South 4 feet of Lot 20, HANOVER PLACE, a subdivision in Kansas City, Jackson County, Missouri.

to be a blighted, unsanitary or undeveloped industrial area in need of industrial development as defined in Section 100.310, RSMo, which constitutes an economic or social liability or a serious and growing menace, which is injurious to the public health, safety, morals, economy and welfare of the residents of Kansas City, and finds that the elimination or prevention of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents.

Section 2. That the Valentine-Broadway (PIEA) General Development Plan being that area of approximately 2.1 acres between Broadway Avenue on the west, Central Street on the east, a line about 150 feet north of 36th Street on the north and a line about 400 feet south of 36th Street on the south, is hereby approved. A copy of said plan is attached hereto and incorporated herein by reference as Document No. __________________.

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

Section 4. That said General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area to the extent and in the manner as provided for in said General Development Plan, and subject to the execution of a development agreement with Planned Industrial Expansion Authority and the developer.
