RESOLUTION NO. 980754

 

Amending the Washington Wheatley/Wendell Phillips/Downtown East Plan by amending the Proposed Land Use Plan and Map for three areas as follows: the first area generally located between I-70 on the north and east, 23rd Street on the south, and Benton Boulevard on the west, by changing the recommended land uses for that area from institutional, industrial and open space uses to industrial, residential and commercial uses; the second area being generally located between 23rd Street on the north, I-70 on the east, 24th Street on the south, and Indiana Avenue on the west, by changing the recommended land uses for that area from open space and commercial uses to industrial uses; and the third area being generally located on the west side of Indiana Avenue, between 23rd and 24th Streets, excluding the parcels fronting on 23rd and 24th Streets, by changing the recommended land uses for that area from residential uses to commercial uses.

 

WHEREAS, on March 14, 1996, the City Council by Resolution No. 960082 adopted the Washington Wheatley/Wendell Phillips/Downtown East Plan being the Plan for development and redevelopment of that area generally located north of 27th Street, east of Troost Avenue, west of I-70, and south of Truman Road; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Washington Wheatley/Wendell Phillips/Downtown East Plan as it affects three areas as follows: the first area generally located between I-70 on the north and east, 23rd Street on the south, and Benton Boulevard on the west, by changing the recommended land uses for that area from institutional, industrial and open space uses to industrial, residential and commercial uses; the second area being generally located between 23rd Street on the north, I-70 on the east, 24th Street on the south, and Indiana Avenue on the west, by changing the recommended land uses for that area from open space and commercial uses to industrial uses; and the third area being generally located on the west side of Indiana Avenue, between 23rd and 24th Streets, excluding the parcels fronting on 23rd and 24th Streets, by changing the recommended land uses for that area from residential uses to commercial uses; and

 

WHEREAS, public notice of hearings before the City Plan Commission were published on November 17, 1997; March 16, 1998; and April 20, 1998; and

 

WHEREAS, the City Plan Commission considered such amendments to the Proposed Land Use Plan and Map on December 2, 1997; April 7, 1998; and May 5, 1998; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on December 2, 1997, April 7, 1998, and May 5, 1998, did recommend approval of the proposed amendment to the Washington Wheatley/Wendell Phillips/Downtown East Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Washington Wheatley/Wendell Phillips/Downtown East Plan is hereby amended as to the Proposed Land Use Plan and Map for three areas as follows: the first area generally located between I-70 on the north and east, 23rd Street on the south, and Benton Boulevard on the west, by changing the recommended land uses for that area from institutional, industrial and open space uses to industrial, residential and commercial uses; the second area being generally located between 23rd Street on the north, I-70 on the east, 24th Street on the south, and Indiana Avenue on the west, by changing the recommended land uses for that area from open space and commercial uses to industrial uses; and the third area being generally located on the west side of Indiana Avenue, between 23rd and 24th Streets, excluding the parcels fronting on 23rd and 24th Streets, by changing the recommended land uses for that area from residential uses to commercial uses. A copy of said amendment to the Washington Wheatley/Wendell Phillips/Downtown East Plan is attached hereto as Exhibit A and incorporated herein by reference.

 


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
