COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 980234

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 5.64 acre tract of land generally located at the northwest corner of Bannister Road and Blue Ridge Boulevard. (4247-CP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 5.64 acre tract of land generally located at the northwest corner of Bannister Road and Blue Ridge Boulevard, and more specifically described as follows:

 

TRACT 1: The west 135.00 feet of Lot 1, all of Lot 2 and the south 55.00 feet of Lot 3 of Foree Heights, a subdivision of land in the City of Kansas City, Jackson County, Missouri, containing 1.86 acres, more or less.

 

TRACT 2: The north 43.00 feet of Lot 3, and all of Lot 4 of Foree Heights, a subdivision of land in the City of Kansas City, Jackson County, Missouri, except the east 120.00 feet of the north 110.00 feet of said Lot 4, containing 1.51 acres, more or less.

 

TRACT 3: The east 120.00 feet of the north 110.00 feet of Lot 4 of Foree Heights, a subdivision of land in the City of Kansas City, Jackson County, Missouri, containing 0.30 acres, more or less.

 

TRACT 4: All that part of Lot 5, Subdivision of Sechrest Estate, a subdivision of land in the City of Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the southeast corner of Camelot Courts, a subdivision of land in the City of Kansas City, Jackson County, Missouri; thence north along the east line of said Camelot Courts, a distance of 334.67 feet, to the point of beginning; thence continuing north along said east line, a distance of 325.79 feet; thence east, parallel to the south line of said Subdivision of Sechrest Estate, a distance of 264 feet, to a point on the west line of Foree Heights, a subdivision of land in the City of Kansas City, Jackson County, Missouri; thence south along said west line, a distance of 325.67 feet; thence west, parallel to said south line, a distance of 264 feet, to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 


2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer provide fire protection as required by the Fire Department.

 

6. That the developer extend sanitary sewers to serve both tracts as required by the Department of Public Works.

 

7. That the developer dedicate additional right of way for Bannister Road as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of Bannister Road.

 

8. That the developer construct sidewalks on Bannister Road and on Blue Ridge Boulevard as required by the Department of Public Works.

 

9. That the developer contribute $27,810.00 to the I-435/I-470 Corridor Study Improvement Fund as required by the Department of Public Works based on a rate of $2.00 per square foot of new retail space.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping and signage (including elevations). The landscaping plan shall identify adequate area for planting of trees and shrubs within the parking lot.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 980234, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
