ORDINANCE NO. 001650

 

Approving a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately an 80.0 acre tract of land generally located on the north side of N.W. 108th Street, approximately 1/2 mile east of N. Robinhood Lane. (8845-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately an 80.0 acre tract of land generally located on the north side of N.W. 108th Street, approximately 1/2 mile east of N. Robinhood Lane, and more specifically described as follows:

 

The West Half of the Northeast Quarter of Section 28, Township 52 North, Range 33 West, of the 5th Principal Meridian, Kansas City, as recorded in Book No. 0872 at page 647, Platte County, Missouri, being particularly more described as follows: Referring to the center of said Section 28, the point of beginning for the described parent parcel; thence northerly North 00E17'29" East, a distance of 2635.66 feet; thence easterly North 89E19'19" East, 1321.68 feet; thence southerly South 00E17'29" West, 2638.02 feet; thence westerly South 89E19'19" West, 1321.65 feet, to the point of beginning for the described parent parcel. Containing a total calculated area of 80 acres +, minus 1.5 acres + for the public right of way, more or less, described as follows: Referring to the center of said Section 28, the point of beginning for the described public right of way; thence northerly North 00E17'29" East, a distance of 50.00 feet; thence easterly North 89E19'19" East, 1321.68 feet; thence southerly South 00E17'29" West, 50.00 feet; thence westerly South 89E19'19" West, 1321.65 feet, to the point of beginning for the described public right of way.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

2. That the developer comply with all Kansas City International Airport height regulations as required by the City.

 

3. That the developer grant an Aviation and Noise Easement to the City as required by the Aviation Department prior to the approval of a final plan.

 

4. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

5. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, screening, grading and building elevations.

A copy of said development plan is on file in the office of the City Clerk under Document No. 001650, which is attached hereto and made a part hereof.

 


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
