ORDINANCE NO. 120924
Directing the City Manager to
cause specific projects to be submitted to the Mid-America Regional Council
(MARC) as applications for the FFY 2012 Transportation Enhancements (TE) and
FFY 2013 Transportation Alternatives (TA) Programs.
WHEREAS, MARC is
soliciting project proposals for Federal Fiscal Years 2012 Transportation
Enhancements funds and 2013 Transportation Alternatives funds in its role as Metropolitan
Planning Organization (MPO) for Greater Kansas City; and
WHEREAS, MARC
anticipates awarding a total of approximately $5.334 million in Missouri TE/TA
funding for the combined FFY 2012 and 2013 years. This funding represents
remaining funds TE from SAFETEA-LU legislation for 2012 and 2013 TA funds from
MAP-21 legislation. Final rules for MAP-21 have not yet been established; and
WHEREAS, MARC has
indicated that in order to make the most progress toward our regional and
transportation visions, the broad policy goals identified in Transportation
Outlook 2040 will serve as a guide for regional transportation investments
during this call for projects. Project proposals submitted for consideration
will be evaluated based on how closely they align with the policy goals of the
plan; and
WHEREAS, MARC
has indicated that TE/TA projects must be in one of the eligible activity
categories and have a direct relationship to surface transportation. These
categories include, but are not limited to, bicycle and pedestrian facilities,
landscaping and scenic beautification, historic preservation, bicycle/pedestrian
safety and educational activities, Safe Routes to School activities, and
mitigation of water pollution due to roadway runoff; and
WHEREAS, MARC
has indicated that in order to demonstrate greater financial commitment by
project applicants and to maximize the distribution of these funds for project
implementation activities, TE/TA funds may not be used for design or
preliminary engineering activities, utility adjustments (unless part of the
enhancement) or right-of-way acquisition. Funding requests for construction
projects should be between $50,000.00 and $500,000.00. For non-construction
projects, funding requests should be between $10,000 and $100,000.00. A 25
percent local match is required for these federal funds; and
WHEREAS, MARC
has indicated that applicants with multiple projects in this round cannot
submit more than 11 applications (calculated by using 105 percent of the
estimated available funds in the funding cycle divided by the $500,000.00
project funding maximum). Federal funding requests cannot include funding to
support preliminary engineering and design work. The project will be open for
public access for at least 25 years or the expected life of the project. The
applicant must demonstrate adequate plans for and commit to ongoing maintenance
costs for this duration. TE funds cannot pay for regular maintenance
activities; and
WHEREAS, MARC
will assess successful project sponsors a fee of half of one percent (0.05
percent) of the total TE/TA funds awarded to each project after project awards
are finalized by the MARC Board of Directors. These fees must be paid using
non-federal funds and may not be counted toward the required local match for
the federal funds. NOW, THEREFORE,
