Approving
a development plan in District GP-7 (Agricultural and Low Density Residential Uses)
on approximately a 20.0 acre tract of land generally located on the south side
of N.W. Barry Road, approximately 1200 feet east of N. Childress Avenue.

BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a development plan in District GP-7 (Agricultural and Low Density
Residential Uses) on approximately a 20.0 acre tract of land generally located
on the south side of N.W. Barry Road, approximately 1200 feet east of N.
Childress Avenue, and more specifically described as follows:
A subdivision of land in the Southwest Quarter
of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri,
being bounded and described as follows: Commencing at the northwest corner of
said Southwest Quarter; thence South 89E49'11"
East, along the north line of said Southwest Quarter, 1206.35 feet; thence
South 00E10'49" East, 40.00
feet to a point on the south right of way line of N.W. Barry Road, as now
established, said point being the true point of beginning of the tract to be
herein described; thence South 89E49'11"
East, along said right of way line, 597.10 feet; thence South 00E13'41" West, 1459.31 feet to a point
on Kansas City city limits line; thence North 89E46'19" west, along said city limits line,
597.10 feet; thence North 00E13'41"
East, 1458.81 feet to the true point of beginning. Containing 20.00 acres,
more or less.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any necessary
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction activities.
4. That
the developer extend water mains and provide easements as required by the Water
Services Department.
5. That
the developer install hard surface roads and provide for fire protection as required
by the Fire Department prior to construction beyond foundations.
6. That
the developer dedicate additional right of way for N.W. Barry Road as required
by the Department of Public Works so as to provide a total of 50 feet of right
of way as measured from the centerline of N.W. Barry Road.
7. That
the developer improve the south half of N.W. Barry Road to primary arterial
street standards as required by the Department of Public Works.
8. That
the developer dedicate additional right of way for N. Chariton Avenue as
required by the Department of Public Works so as to provide a total of 60 feet
of right of way as measured from the centerline of N. Chariton Avenue.
9. That
the developer construct the north 900 feet of N. Chariton Avenue to collector
street standards and the south 550 feet (approximately) of N. Chariton Avenue
to residential street standards as required by the Department of Public Works.
10. That
the developer construct a temporary cul-de-sac at the south end of N. Chariton
Avenue as required by the Department of Public Works.
11. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
12. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
13. That
the developer submit a street name signage plan for the entire development to
the Street Naming Committee for approval prior to submittal of a final plat.
14. That
the developer extend sanitary sewers as required by the Department of Public
Works.
15. That
the developer grant an Aviation and Noise Easement to the City as required by
the Aviation Department.
16. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping (including the future parking areas with
islands, berms and pedestrian walkways), screening, signage (including
elevations), grading and building elevations.
A
copy of said development plan is on file in the office of the City Clerk under
Document No. 001292, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed development plan hereinabove, all public notices and hearings required
by the Zoning Ordinance have been given and had.
