ORDINANCE NO. 961256
Approving a Community Unit Project on a tract of land of
approximately 45.18 acres generally located on the west side of U.S. Highway
169, extending from approximately N.W. 76th Street north to approximately N.W.
78th Terrace. (11841-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on a tract
of land of approximately 45.18 acres generally located on the west side of U.S.
Highway 169, extending from approximately N.W. 76th Street north to
approximately N.W. 78th Terrace, and more specifically described as follows:
That part of the south 48 acres of the West One-Half
of the Northeast Quarter of Section 15, Township 51, Range 33, in Clay
County, Missouri, described as follows: Beginning at a point on the west
line of the Northeast Quarter of said Section 15, that is 180 02'52"
a distance of 1061.60 feet from the northwest corner thereof; thence 89
41'24" along the south line of the Orchard Hill Addition (north line of
aforesaid 48 acre tract) a distance of 1130.91 feet to the westerly right
of way line of U.S. 169 Highway, at Station 273+99.37; thence 173
37'48" along said westerly right of way a distance of 216.55 feet
right angles to Station 276+00; thence 175 00'06" along said westerly
right of way line a distance of 525.89 feet; thence 89 41'24" along
said westerly right of way line of distance of 50.00 feet; thence 175 06'45"
along said westerly right of way line a distance of 469.15 feet to Station
286+00; thence 166 30'12" along said westerly right of way line a
distance of 104.80 feet to Station 287+04; thence 178 25'49" along
said westerly right of way line a distance of 287.29 feet to the south
line of the Northeast Quarter of Section 15, and southeast corner of the
aforesaid 48 acre tract; thence 269 51'46" along the south line of the
West One-Half of the Northeast Quarter of said Section 15 a distance of 1324.37
feet to the center of said Section 15; thence 0 02'52" along the west
line of the Northeast Quarter of said Section 15, a distance of 1592.41
feet to the point of beginning, except any part in roadway. Directions
are in Azimuths 0 00'00" being north, thence clockwise.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first plat is submitted and that the
developer make any improvements as required by
the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer install hard surface roads
and provide for fire protection prior to construction beyond
foundations as required by the Fire Department.
5. That the developer extend water mains as
required by the Water Services Department.
6. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
7. That the developer provide for fire protection
and temporary fire access as required by the Fire Department.
8. That the developer submit a street name sign
plan for approval by the Street Naming Committee.
9. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works.
10. That the developer submit a street tree
planting plan as part of the final plat and secure the approval of
the City Forester for street trees planted on right of way. A
copy of the street tree planting plan shall be
submitted to the Department of City
Development.
11. That the developer provide the collector street
connection from the south for a second permanent access before
construction of the second phase of apartments as shown on
the Community Unit Project Plan.
12. That the developer submit a final plat to the
City Plan Commission for approval, including plans for landscaping
and screening.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 961256, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
