COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090617

 

Amending Ordinance No. 65671, Sections 1 and 3 which vacated a portion of Juniper Avenue north of N.W. Barry Road, Kansas City, Platte County, Missouri, which will correct the legal description, and directing the City Clerk to record certain documents. (955-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Ordinance No. 65671 is hereby amended by repealing Sections 1 and 3 and replacing those sections with new sections that will correct the legal descriptions, to read as follows:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 19th day of March, 1990, a petition was filed with the City Clerk of Kansas City by Ray W. Gibson for the vacation of all that part of Juniper Avenue as shown on the Plat of Wildwood, a subdivision in Kansas City, Platte County, Missouri, described as follows: Beginning at the southeast corner of Lot 2, Wildwood; thence North 0 degrees 00 minutes 00 seconds East along the east line of Lots 2 and 3. a distance of 167.75 feet; thence South 29 degrees 59 minutes 54 seconds East, a distance of 90.00 feet; thence South 00 degrees 00 minutes 00 seconds East, 90.26 feet to the north line of N.W. Barry Road; thence North 89 degrees, 25 minutes 00 seconds West, a distance of 45.00 feet to the point of beginning, and all utility easements over, under along and across said street, all in Kansas City, Platte County, Missouri, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 3. That all that part of Juniper Avenue as shown on the Plat of Wildwood, a subdivision in Kansas City, Platte County, Missouri, described as follows: Beginning at the southeast corner of Lot 2, Wildwood; thence North 0 degrees 00 minutes 00 seconds East along the east line of Lots 2 and 3. a distance of 167.75 feet; thence South 29 degrees 59 minutes 54 seconds East, a distance of 90.00 feet; thence South 00 degrees 00 minutes 00 seconds East, 90.26 feet to the north line of N.W. Barry Road; thence North 89 degrees, 25 minutes 00 seconds West, a distance of 45.00 feet to the point of beginning, and all utility easements over, under along and across said street, all in Kansas City, Platte County, Missouri, be and the same is hereby vacated.

 

Section B. That the remaining sections of Ordinance No. 65671 shall remain in effect.

 

Section C. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri;
