ORDINANCE NO. 110368

Authorizing a first amendment to a legal services agreement with Spradley & Riesmeyer adding $200,000.00; appropriating $200,000.00 to the KC Airports Fund; and recognizing an emergency.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Attorney is hereby authorized to execute a first amendment to a legal services agreement with Spradley & Riesmeyer, Kansas City, Missouri, a professional corporation, adding $200,000.00 for a total contract amount of $400,000.00 for representation of the City in BBA U.S. Holdings, et al. v. City of Kansas City, Missouri, et. al., filed in the Circuit Court of Jackson County, Missouri. A copy of the amendment is on file in the City Clerk’s Office.

Section 2. That the sum of $200,000.00 is appropriated from the Unappropriated Fund Balance of the KC Airports Fund to the following account:

12-8300-622100-B Legal Services $200,000.00

Section 3. That this ordinance is recognized as an emergency measure within the provisions of Section 503(a)3(c) of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
