ORDINANCE NO. 961401

 

Approving the preliminary plat of Waffle House at Parvin Road on a .94 acre tract of land located at the southwest corner of N.W. Parvin Road and I-435. (SD 0758)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Waffle House at Parvin Road on a .94 acre tract of land located at the southwest corner of N.W. Parvin Road and I-435, and more specifically described as follows:

 

All that part of the Southeast 1/4 of Section 4, Township 50, Range 32, in Kansas City, Clay County, Missouri, lying above the top of the winterset ledge of limestone rock, described as follows: Commencing at the southeast corner of said 1/4 Section; thence North 89 18'08" West along the south line of said 1/4 Section, 1078.12 feet; thence North 22 54'34" East, 826.90 feet; thence South 67 05'26" East, 30.00 feet; thence North 22 54'34" East, 111.15 feet; thence northeasterly and easterly along a curve to the right, tangent to the last described course, having a radius of 35.00 feet, an arc distance of 53.49 feet, to a point on the southerly right of way line of N.E. Parvin Road, as established by a Corporation Easement Conveyance dated February 10, 1978, and filed for record in Book 1311 at page 107, as Document No. D-70761 on June 22, 1978 in the office of the Recorder of Deeds for Clay County, Missouri at Liberty; thence southeasterly along said right of way line, being a curve to the left having a radius of 1490.40 feet, tangent to the last described curve, an arc distance of 206.95 feet to the true point of beginning of the tract of land to be herein described; thence South 22 54'34" West, 192.44 feet, thence South 67 02'51" East (deed South 67 05'26" East), 260.32 feet (deeded 261.23 feet), to a point on the westerly right of way line of Interstate Route No. I-435, being a point 186.00 feet southwesterly of an angle point on said westerly right of way line that is opposite and 410.00 feet westerly of Station 644+50 on the centerline of said Interstate Route I-435; thence North 1 13'41" East along said westerly right of way line 186.00 feet; thence North 62 43'08" West, continuing along said westerly right of way line, a distance of 147.60 feet; thence North 10 53'07" East continuing along said westerly right of way line, 17.00 feet to a point on the southerly right of way line of said N.E. Parvin Road; thence northwesterly along said southerly right of way line, being a curve to the right, having a radius of 1490.40 feet, and an initial tangent bearing of North 79 04'53" West, an arc distance of 41.69 feet to the point of beginning, containing 0.9395 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval for the entire development and that the developer make any improvements

as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer improve one-half of N.E. Parvin Road to primary arterial standards, including sidewalks, curbs, gutters and streetlights.

 

5. That the developer improve N. Randolph Road to collector street standards.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer obtain a permit from the Missouri Highway and Transportation Department prior to working in State Highway right of way.

 

9. That the developer grant a permanent easement on the driveway from Randolph Road westerly approximately 60 feet from the east property line for public and emergency

vehicular access and turnaround.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 961401, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
