Approving a preliminary GP
development plan in District GP-7 on approximately a 3.12 acre tract of land generally
located on the south side of N.W. 108th Street, approximately one-half mile
west of Platte Purchase Drive. (13834-GP)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
a preliminary GP development plan in District GP-7 (Agricultural and
Low-Density Residential) on approximately a 3.12 acre tract of land generally
located on the south side of N.W. 108th Street, approximately one-half mile
west of Platte Purchase Drive, and more specifically described as follows:
All
that part of the Southeast Quarter of Section 28, Township 52, Range 33, Kansas
City, Platte County, Missouri, being bounded and described as follows:
Commencing at the Northwest corner of the Southeast Quarter of said Section 28;
thence North 8921'12" East, along the North line of said Southeast Quarter,388.55
feet to the Northwest corner of a tract conveyed to George Wayne Steinmeier by
Quiet Title Judgment as recorded in Book 642 at Page 259 in the Office of the
Recorder of Deeds in said Platte County, Missouri, said point being the True
Point of Beginning of the tract to be herein described; thence continuing
North 8921'12" East (Deed - East), along said North line, 168.10 feet;
thence South 022'04" West (Deed - S029'40"W), 857.40 feet; thence
South 8921'12" West (Deed - West), along the South line of a tract
conveyed in Book 619 at Page 625, in the Office of the Recorder of Deeds and
its prolongation West, 160.79 feet to a point on an existing fence line (as
described in the Quiet Title Judgment as recorded in Book 642 at Page 259);
thence North 011'21" West, along said line, 357.37 feet; thence North
004'19" West (Deed - N004'00"E), along said fence line (as
described in said Book 642 at Page 259) and its prolongation North, 500.00
feet to the True Point of Beginning. Containing 3.24 acres, more or less,
except that part on the North being used for road right-of-way.
is hereby approved, subject to
the following conditions:
1.
That the developer submit a detailed micro storm drainage study,
consisting at a minimum of a letter from a Missouri licensed civil engineer
stating that the proposed improvements will not alter or increase historical
runoff conditions for the site, to Development Services prior to review and
issuance of any building permits, and that the developer construct any
improvements as required by Development Services.
2.
That the developer dedicate additional right of way by deed for a
primary arterial with a bike lane as required by Development Services so as to
provide a minimum of 75 feet of right of way as measured from the centerline of
108th Street.
3.
That the developer subordinate to the City all private interest
in the area of any right-of-way dedication as required by Development Services,
and that the developer be responsible for all costs associated with
subordination activities.
4.
That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities.
5.
That the developer secure a site disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area equals one acre or more.
6.
That public sanitary sewer system need not be extended provided
that the developer demonstrates that the existing private sewage disposal
system complies with Chapter 18, Kansas City Building and Rehabilitation Code,
Code of Ordinances, at the time of each application for building permits which
may add plumbing fixtures.
7.
That the developer receive all required variances from the Board
of Zoning Adjustment prior to submittal of a final GP development plan.
8.
That the developer submit a final GP
development plan to the City Plan Commission for approval, including plans for
grading, landscaping, screening, berming, photometric study showing zero
footcandles at the property lines, signage, and building elevation drawings.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
