COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 990103
Approving the preliminary plat of Summerfield on
approximately a 9.98 acre tract of land generally located between N. Main
Street and N. Oak Trafficway at N.E. 113th Street. (SD 0805)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That the preliminary
plat of Summerfield on approximately a 9.98 acre tract of land generally
located between N. Main Street and N. Oak Trafficway at N.E. 113th Street, and
more specifically described as follows:
All of Lots 7, 8, 9, 10,
11 and 12, Elmwood Village, a subdivision in Kansas City, Clay County,
Missouri. Also, all that part of the Southwest Quarter of Section 23, Township
52, Range 33, described as follows: Beginning at a point in the east line of
said Quarter Section that is 500.00 feet north of the southeast corner thereof;
thence North 8943'20" West and parallel to the south line of said Quarter
Section, a distance of 208.75 feet to the point of beginning of the tract
hereby conveyed; thence North 8943'20" West, 426.84 feet; thence North
2232'00" East and along the east line of a tract of land described in
Book 473 at page 120 in the Recorder of Deeds Office of Clay County, a distance
of 468.93 feet; thence South 8943'20" East 458.14 feet to a point in the
east line of said Quarter Section; thence South 0018'00" West along said
east line 225.25 feet; thence North 8943'20" West, 208.75 feet; thence
South 0018'00" West, 208.75 feet to the point of beginning; all in Kansas
City, Clay County, Missouri. Also, all that part of the Southwest Quarter of
Section 23, Township 52, Range 33, in the City of Kansas City, Clay County,
Missouri, described as follows: Commencing at the southeast corner of the
Southwest Quarter of said Section 23; thence North 0018'00" East, along
the east line of the Southwest Quarter of said Section 23, a distance of 534.70
feet; thence North 8943'20" West along a line parallel with the south
line of the Southwest Quarter of said Section 23, a distance of 621.40 feet to
the point of beginning of the tract of land herein to be described; thence
North 2232'00" East, a distance of 280.93 feet; thence North
8140'26" West, a distance of 307.12 feet; thence North 0016'40"
East, along a line parallel with east line of the Southwest Quarter of said
Section 23, a distance of 402.30 feet to a point on the south line of Lot 2,
Crawfords Addition, a subdivision of land in the City of Kansas City, Clay
County, Missouri; thence North 8943'20" West, along the south line of Lots
2 and 3 of said Crawfords Addition, a distance of 67.00 feet to the northeast
corner of Lot 12, Elmwood Village, a subdivision of land in the City of Kansas
City, Clay County, Missouri; thence South 0016';40" West, along the east
line of said Elmwood Village, a distance of 705.30 feet to the southeast corner
of Lot 6, of said Elmwood Village; thence South 8943'20" East, along a
line parallel with the south line of the Southwest Quarter of said Section 23,
a distance of 264.70 feet to the point of beginning. Said tract of land
contains 9.98 acres more or less.
is hereby approved,
subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer extend water mains as required by the Water Services Department.
6. That
the developer provide for fire protection as required by the Fire Department.
7. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots with a copy to be submitted to the Department
of City Development. The plan shall include size, type, species and placement
of trees.
8. That
the developer extend sanitary sewers as required by the City Engineers Office.
9. That
the developer dedicate additional right of way for N. Oak Trafficway as
required by the Department of Public Works so as to provide 50 feet of right of
way as measured from the centerline of N. Oak Trafficway.
10. That
the developer improve one-half of N. Oak Trafficway to primary arterial street
standards as required by the Department of Public Works, including construction
of curbs, gutters and sidewalks and installation of sidewalks.
11. That
the developer improve N.E. 113th Street from the western boundary of the
preliminary plat to N. Main Street as required by the Department of Public
Works so as to provide 24 feet in width of asphalt pavement with an asphalt
pavement depth of eight (8) inches.
12. That
the developer contribute $9,528.02 in lieu of parkland dedication for 40
single-family lots (40 lots x 3.7 persons/lot x 0.006 acres/person x $10,729.75
= $9,528.02) in satisfaction of Section 66-128 of the Subdivision Regulations.
13. That
the developer secure the approval of the Street Naming Committee for all street
names prior to the submittal of the final plat.
14. That
the developer submit covenants, conditions and restrictions for the detention
basin as shown on the preliminary plat to the Law Department for approval.
A copy of the preliminary plat is on file in the
office of the City Clerk under Document No. 990103, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed preliminary plat
hereinabove, all public notices and hearings required by the Subdivision
Regulations have been given and had.
