ORDINANCE NO. 140357

 

Authorizing the Manager of Procurement Services to enter into a 5-year contract with Town and Country Disposal of Western Missouri, Inc., for residential curbside collection and processing of materials for City residents.

 

WHEREAS, the City solicited proposals for the operation of its curbside recyclable materials collection and processing program; and

 

WHEREAS, Section 3-41(a)(2), Code of Ordinances, requires the Manager of Procurement Services, to obtain City Council authorization to enter into contracts that may exceed $1,200,000.00; and

 

WHEREAS, Town and Country Disposal of Western Missouri, Inc. (Town and Country) was determined to be the best proposer and has been selected to provide this service; and

 

WHEREAS, Town and Country will assume full operation of the curbside recyclable materials collection and processing for every part of the City not being serviced by the City employees; and

 

WHEREAS, the services will continue to be provided on a weekly basis such that residents will experience no disruption or change in services as they presently exist; and

 

WHEREAS, this contract will include the participation of a certified minority business enterprise for the life of the contract; and

 

WHEREAS, the General Services Department estimates it will spend $3,197,400.00 in Fiscal Year 2014-2015 from funds previously appropriated for this contract; and

 

WHEREAS, funds have been appropriated for the fiscal year beginning May 1, 2014; and

 

WHEREAS, the continuation of the contract for all or part of subsequent fiscal years is contingent upon the future appropriation of funds for that purpose; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Manager of Procurement Services is authorized to execute, on behalf of City, a 5-year contract with Town and Country Disposal of Western Missouri, Inc. for residential curbside collection and processing of recyclable materials and to expend $3,197,400.00 from funds previously appropriated to Account No. 15-1000-892330-B, to satisfy the City’s obligations under the contract for the period of May 1, 2014 through April 30, 2015. A copy of the contract, in substantial form, is on file in the General Services Department.

 

Section 2. That the contract may be extended by the Manager of Procurement Services for up to five additional one-year periods.

 

Section 3. That the continuation of this contract, and any extension thereof, beyond the fiscal year ending April 30, 2015 shall be contingent upon the annual appropriation of funds for that purpose.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
