ORDINANCE NO. 000388

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0263, rezoning an area of approximately 0.07 acres generally located approximately 400 feet west of N. Oak Trafficway and 135 feet south of N.E. 85th Terrace from District R-1a (One-Family Dwellings) to District C-3a1 (Intermediate Business, Low Buildings). (6973-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0263, rezoning an area of approximately 0.07 acres generally located approximately 400 feet west of N. Oak Trafficway and 135 feet south of N.E. 85th Terrace from District R-1a (One-Family Dwellings) to District C-3a1 (Intermediate Business, Low Buildings), said section to read as follows:

 

Section 80-11A0263. That an area legally described as:

 

All that part of the Northwest Quarter of Section 11, Township 51, Range 33, being also a part of Tract 2, Commissioners Plat of Pauline Carpenter Estate, and part of the abandoned Quincy, Omaha and Kansas City Railroad right of way located within Commissioners Plat of Pauline Carpenter Estate, all in Kansas City, Clay County, Missouri, being more particularly described as follows: Beginning at a point 487.30 feet north of the southeast corner of the Northwest Quarter of said Section 11; thence South 89E55'08" West, along the south line of said Tract 2 and its easterly prolongation, 357.27 feet to its intersection with the easterly right of way line of said Quincy, Omaha and Kansas City Railroad, said point being the true point of beginning of the tract to be herein described; thence continuing South 89E55'08" West, along said south line, 55.18 feet to a point on the centerline of Quincy, Omaha and Kansas City Railroad; thence North 00E40'36" East, 114.97 feet to a point on said easterly right of way line; thence South 25E06'06" East, along said easterly right of way line, 126.87 feet to the true point of beginning. Containing 0.07 acres, more or less.

 

is hereby rezoned from District R-1a (One-Family Dwellings) to District C-3a1 (Intermediate Business, Low Buildings), all as shown outlined on a map marked Section 80-11A0263, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
