ORDINANCE NO. 030510
Authorizing the purchase
of 8.78 acres of land generally located at 6307 N.W. Waukomis for future public
use as an addition to Frank Vaydik Park; authorizing acceptance of the deed to
said property and expenditure of $142,400.00; and directing the City Clerk to
file certain documents with the appropriate offices.
WHEREAS, the
Council finds and determines that the purchase of certain land is necessary as
an addition to Frank Vaydik Park in Platte County, Missouri and the Board of
Parks and Recreation Commissioners has recommended to the Council that the deed
be accepted for such public use for park purposes; NOW, THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of the Department of City Development is hereby authorized to
exercise an option to purchase 8.78 acres of land generally located at 6307
N.W. Waukomis in Kansas City, Platte County, Missouri, for future public use
for park purposes in accordance with Article III, Section 58 of the Charter of
Kansas City, as an addition to Frank Vaydik Park and to pay as consideration
the sum of $142,400.00. The legal description of the property to be purchased
is as follows:
All of
Tract B, Clayton Meadows West, a subdivision of land in Kansas City, Platte
County, Missouri, and all that part of Flickers Addition, a subdivision of land
in Kansas City, Platte County, Missouri, more particularly described as
follows: Commencing at northwest corner of the south half of the Northeast
Quarter of Section 28, Township 51, Range 33; thence South 89E20'58" East along the north line of the south half of the
Northeast Quarter of said Section 28, a distance of 947.50 feet to the point of
beginning of the tract of land herein to be described: thence North 20E26'53" West along the east right-of-way line of N.W. Waukomis
Drive, a distance of 182.30 feet; thence South 89E20'58"
East, a distance of 433.30 feet; thence South 0E39'02"
West, a distance of 120.07 feet; thence South 89E20'58"
East, a distance of 269.16 feet; thence South 52E00'01"
East, a distance of 82.42 feet; thence South 26E01'42"
West, a distance of 232.15 feet; thence South 19E19'45"
West, a distance of 314.37 feet; thence South 30E41'20"
West, a distance of 302.50 feet; thence South 82E28'23"
West to a point on the east right-of-way line of N.W. Waukomis Drive, a
distance of 51.30 feet; thence North 20E26'53" West
along the east right-of-way line of N.W. Waukomis Drive, a distance of 832.89
feet; thence North 89E20'58" West along the east right-of-way line of
N.W. Waukomis Drive, a distance of 57.34 feet to the point of beginning. Said
tract of land contains 8.78 acres more or less.
Section 2. That
the Director of Parks and Recreation is hereby authorized to expend the sum of
$142,400.00 as consideration for the purchase, upon receipt of a deed conveying
to Kansas City good and merchantable title to the property, in a form
acceptable to the Director of Parks and Recreation and approved by the City
Attorney.
Section 3. That
upon the effective date of this ordinance, the City Clerk is hereby directed to
cause this ordinance to be recorded in the Office of the Recorder of Deeds for
Platte County, Missouri, as evidence of the acceptance of the herein described
property by the City for public use for park purposes. The Council does
declare in accordance with the recommendation by the Board of Parks and
Recreation Commissioners, that said lands in accordance with Section 58 of
Article III of the Charter of Kansas City shall remain as part of the parks
system forever.
