Repealing
Committee Substitute for Ordinance No. 970633, which authorized a solid waste
collection and disposal agreement, and in lieu thereof, to conform to the bid
and proposed agreement that was accepted and approved May 1, 1997, authorizing
the Director of Environmental Management to enter into an agreement with
Deffenbaugh Disposal Services, Inc., for the collection and disposal of solid
waste from approximately 73,000 City dwelling units (at the rate of $3.39 per
month per dwelling unit for year one of the contract) for the period June 1,
1997 through April 30, 2000, with options to extend the agreement for up to
five additional one-year periods and authorizing the expenditure of
$3,062,976.00 in previously appropriated funds in FY 98-99 therefor.

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That Committee Substitute for Ordinance No. 970633 passed May 15, 1997, is
hereby repealed.
Section
2. That the Director of Environmental Management is hereby authorized, on
behalf of the City, to enter into an agreement with Deffenbaugh Disposal
Services, Inc., in accordance with the bid accepted and approved May 1, 1997,
for the collection and disposal of solid waste from approximately 73,000
dwelling units in the northern and southern zones of the City (at a rate of
$3.39 per month per dwelling unit for year one of the contract) for the period
June 1, 1997 through April 30, 2000, with options to extend the agreement for
up to five additional one year periods. A copy of the agreement is on file in
the office of the Director of Environmental Management and is incorporated
herein by reference.
Section
3. That the Director of Environmental Management is hereby authorized to
expend a sum not to exceed $3,062,976.00 in previously appropriated funds in
Account No. 99-100-085-2300-B for that agreement.

hereby certify that there is a balance, otherwise unencumbered, to the credit
of the appropriation to which the foregoing expenditure is to be charged, and a
cash balance, otherwise unencumbered, in the treasury, to the credit of the
fund from which payment is to be made, each sufficient to meet the obligation
hereby incurred.
