ORDINANCE NO. 080315
Authorizing a $260,150.00
Amendment No. 2 to a contract with HNTB Corporation for Contract No. 106,
design of the Troost at Brush Creek Channel Improvements project from
previously appropriated funds; and recognizing an emergency.
WHEREAS, the
City and HNTB executed Contract No. 106 and a first amendment totaling
$1,829,694.00 following approval of Ordinance No. 070182 in February, 2007 for bridge, channel, roadway and associated improvements for the
Troost at Brush Creek project; and
WHEREAS, a second amendment is needed to complete the final design and prepare bid documents for
a new water transmission line along Emanuel Cleaver II Boulevard, to integrate
the public art component into the bridge, to incorporate a fountain into the
Brush Creek Channel east of the new bridge, and to extend the Troost Avenue
streetscape improvements; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Water Services Department is hereby authorized to execute, on
behalf of Kansas City, a $260,150.00 Amendment No. 2 to Contract No. 106 with
HNTB Corporation for additional design work associated with the Troost at Brush
Creek Channel Improvements project, from funds previously appropriated to
Account No. 08-3090-807521-B. A copy of the
contract amendment is on file in the office of the Director of Water Services.
Section 2. That this ordinance, relating to the design, repair,
maintenance or construction of a public improvement, is recognized as an
emergency measure within the provisions of Section 503 of the City Charter and
shall take effect in accordance with that section.

I hereby certify that there is a balance,
otherwise unencumbered, to the credit of the appropriation to which the
foregoing expenditure is to be charged, and a cash balance, otherwise
unencumbered, in the treasury, to the credit of the fund from which payment is
to be made, each sufficient to meet the obligation hereby incurred.
