ORDINANCE NO. 970821

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0068, rezoning an area of approximately 0.81 acres generally located at the southeast corner of Booth Avenue and 67th Terrace from District C-3a1 (Intermediate Business, Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business, Low Buildings), and approving a development plan for the same. (5072-PD-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0068, rezoning an area of approximately 0.81 acres generally located at the southeast corner of Booth Avenue and 67th Terrace from District C-3a1 (Intermediate Business, Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business, Low Buildings), said section to read as follows:

 

Section 80-11A0068. That an area legally described as:

 

A tract of land located in the Northeast Quarter of Section 7, Township 48, Range 32, Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northeast corner of said Northeast Quarter; thence North 87 56'41" West along the north line of said Northeast Quarter a distance of 1,422.21 feet; thence South 02 21'29" West a distance of 40.13 feet to a point at the intersection of the south right of way line of 67th Street and the east right of way line of Booth Avenue; thence continuing South 02 21'29" West along said east right of way line a distance of 360.11 feet to the point of beginning of the tract of land to be described; thence South 86 48'31" East a distance of 194.23 feet; thence South 02 21'29" West a distance of 192.34 feet; thence North 87 38'31" West a distance of 194.21 feet to a point on said east right of way line; thence North 02 21'29" East along said east right of way line a distance of 195.16 feet to the point of beginning. Except that part as follows: Commencing at the northeast corner of said Northeast Quarter; thence North 87 56'41" West along the north line of said Northeast Quarter a distance of 1,452.21 feet; thence South 02 21'29" West a distance of 575.25 feet; thence South 87 38'31" East a distance of 159.21 feet to the point of beginning of the tract of land to be described; thence North 02 21'29" East a distance of 45.00 feet; thence South 87 38'31" East a distance of 50.00 feet; thence South 02 21'29" West a distance of 50.00 feet; thence North 87 38'31" West a distance of 50.00 feet; thence North 02 21'29" East a distance of 5.00 feet to the point of beginning. Contains 35,129 square feet or 0.806 acres more or less.

 

is hereby rezoned from District C-3a1 (Intermediate Business, Low Buildings) to District PD/C-3a1 (Planned District/Intermediate Business, Low Buildings), all as shown outlined on a map marked Section 80-11A0068, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any necessary improvements as required by the

City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for Booth Avenue as required by the Department of Public Works so as to provide 30 feet of right of way as measured

from the centerline of Booth Avenue.

 

5. That the developer improve one-half of Booth Avenue to collector street standards as required by the Department of Public Works prior to the issuance of a building

permit for Phase 2, as shown on the development plan.

 

6. That the developer dedicate additional right of way for 67th Terrace as required by the Department of Public Works so as to provide 60 feet of right of way for 67th

Terrace.

 

7. That the developer improve 67th Terrace to collector street standards as required by the Department of Public Works prior to the issuance of a building permit for Phase

2, as shown on the development plan.

 

8. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

9. That the developer extend water mains as required by the Water Services Department as streets are constructed and/or improved.

 

10. That the developer provide for fire protection as required by the Fire Department.

 

11. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 970821, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
