COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001501, AS AMENDED

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0321, rezoning an area of approximately 13.02 acres generally located at the northwest corner of N.W. 108th Street and Highway 169 (east of the proposed north/south collector) from Districts R-1b (One-Family Dwellings) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), and approving a preliminary plan for the same. (10876-CP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0321, rezoning an area of approximately 13.02 acres generally located at the northwest corner of N.W. 108th Street and Highway 169 (east of the proposed north/south collector) from Districts R-1b (One-Family Dwellings) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), said section to read as follows:

 

Section 80-11A0321. That an area legally described as:

 

A tract of land in the Northeast Quarter of Section 27, Township 52, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the southwest corner of said Northeast Quarter; thence South 89E26'14" East, along the south line of said Northeast Quarter, 1225.51 feet; thence North 00E33'46" East, 30.00 feet to the true point of beginning of the tract to be herein described; thence North 00E34'45" East, 610.78 feet; thence South 89E25'15" East, 30.00 feet; thence North 70E31'58" East, 114.56 feet; thence South 89E25'15" East, 904.61 feet to a point on the westerly right of way line of U.S. Highway 169, as now established; thence South 14E08'34" West, along said westerly line, 572.33 feet to a point on the northerly right of way line of N.W. 108th Street, as now established; thence North 89E52'52' West, along said northerly line, 447.67 feet; thence South 78E48'32" West, along said northerly line, 254.92 feet; thence South 00E07'08" West, along said northerly line, 38.03 feet; thence North 89E26'14" West, along said northerly line, 211.10 feet to the true point of beginning. Containing 13.02 acres, more or less.

 

is hereby rezoned from Districts R-1b (One-Family Dwellings) and CP-2 (Local Planned Business Center) to District CP-2 (Local Planned Business Center), all as shown outlined on a map marked Section 80-11A0321, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the final plat is submitted and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer enter into a Cooperative Agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute a total of $80,216.00 for the improvement of N.W. 108th Street (Shoal Creek Parkway).

 

7. That the developer provide for fire protection as required by the Fire Department.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer dedicate additional right of way for N.W. 108th Street (Shoal Creek Parkway) as required by the Board of Parks and Recreation Commissioners so as to provide a minimum of 120 feet of right of way as measured from the centerline of N.W. 108th Street (Shoal Creek Parkway).

 

11. That the developer improve the north half of N.W. 108th Street (Shoal Creek Parkway) to parkway street standards as required by the Board of Parks and Recreation Commissioners, including construction of curb, gutters and sidewalks and installation of streetlights.

 

12. That the developer comply with the Kansas City International Airport Height Zoning restrictions and that such restrictions be included on the final plat.

 

13. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

14. That the developer provide cross-access easements for each final plat as required by the Department of Public Works.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming and signage.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 001501, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
