COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 031041

Amending the Red Bridge N.W. Land Use Plan by amending the Proposed Land Use Plan and Map for approximately 1.12 acres generally located in an area north of the termination of E. 108th Street, east of State Line Road and approximately 600 feet south of Carondelet Drive by changing the recommended land uses from commercial (.35 FAR) and hotel/office/institutional (.43 FAR) to office and institutional, and amending the development guidelines to that plan. WHEREAS, on March 28, 1986, the City Council by the adoption of Resolution No. 59104, As Amended, adopted the Red Bridge N.W. Land Use Plan being the Plan for development and redevelopment of the area generally bounded on the north by Interstate Highway 435, on the west by State Line Road, on the south by Red Bridge Road and on the east by Wornall Road; and

 

WHEREAS, said Land Use Plan has been amended by Resolution No. 63521, adopted March 9, 1989; by Committee Substitute for Resolution No. 63590, As Amended, adopted May 11, 1989; by Committee Substitute for Resolution No. 65293 adopted April 12, 1990; by Resolution No. 950341 adopted April 13, 1995; and by Resolution No. 990999, adopted September 2, 1999; and

 

WHEREAS, due to further study by the City Development Department, an amendment was prepared to modify certain portions of the Red Bridge N.W. Land Use Plan by changing the Plan as it affects that area of approximately 1.12 acres generally located in an area north and east of the termination of E. 108th Street, east of State Line Road and approximately 600 feet south of Carondelet Drive by changing the recommended land from commercial (.35 FAR) and hotel/office/institutional (.43 FAR) to office and institutional; and

 

WHEREAS, a public hearing of the City Plan Commission was held on August 19, 2003, concerning the proposed amendment; and

 

WHEREAS, notice of said public hearing was published on June 30, 2003; and

 

WHEREAS, after all interested persons were given an opportunity to be heard, on August 19, 2003, the City Plan Commission did recommend approval of the proposed amendment to the Red Bridge N.W. Land Use Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Red Bridge N.W. Land Use Plan as approved by Resolution No. 59104, As Amended, and as amended by Resolution No. 63521, by Committee Substitute for Resolution No. 63590, As Amended, by Resolution No. 65293, and as amended by Resolution No. 950341, and as further amended by Resolution No. 990999, is hereby amended as to the Proposed Land Use Plan and Map for an area of approximately 1.12 acres generally located in an area north and east of the termination of E. 108th Street, east of State Line Road and approximately 600 feet south of


Carondelet Drive by changing the recommended land use from commercial (.35 FAR) and hotel/office/institutional (.43 FAR) to office and institutional. A copy of the amendment of the Red Bridge N.W. Land Use Plan and Map is on file in the office of the City Clerk under Document No. 031041, which is incorporated herein by reference.

 

Section B. That the map for the Red Bridge N.W. Land Use Plan, be amended to eliminate the paragraph 18 of the Red Bridge Plan Development Guidelines.

 

Section C. That the amendment to the Red Bridge N.W. Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section D. That the Council finds and declares that before taking any action on the proposed amendment, all public notices and hearings required by law have been given and had.
