RESOLUTION NO. 941542

Amending the South Development Area Plan to delete from the Plan that area from Blue Ridge Boulevard to the Jackson County-Cass County line in between U.S. Highway 71 and State Line Road.

WHEREAS, on January 15, 1971, City Council by Ordinance No. 38861 adopted the South Development Area Plan being the Plan for development and redevelopment of that area bounded by 85th Street on the north, Cass County line on the south, Lee's Summit city limits on the east and State Line on the west; and

WHEREAS, said Plan has been amended since that time, the last amendment being in July, 1994; and

WHEREAS, by Resolution No. 62809, adopted August 31, 1988, the City Council adopted the Martin City Area Plan for that area located between Blue Ridge Boulevard and the Jackson County-Cass County line, between 71 Highway and State Line Road; and

WHEREAS, further amendments have been approved and are pending for the Martin City Area Plan; and

WHEREAS, it is appropriate to delete the area described in the Martin City Area Plan from the South Development Area Plan so as to avoid duplicity; and

WHEREAS, the City Plan Commission considered an amendment to delete from the South Development Area Plan that area described in the Martin City Area Plan on October 3, 1994; and

WHEREAS, public notice of the hearing was given on October 3, 1994, and all interested persons were given an opportunity to present testimony before the City Plan Commission; and

WHEREAS, on October 18, 1994, the City Plan Commission recommended approval of the proposed amendment to the South Development Area Plan; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That the South Development Area Plan is hereby amended to delete therefrom that area between Blue Ridge Boulevard to Jackson County-Cass County line and between U.S. Highway 71 and State Line Road.

Section B. That all public notices and hearings required by law have been given and had.
