ORDINANCE NO. 951425
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2615, rezoning an area of approximately 2.77
acres generally located on the east side of Blue Ridge Boulevard, approximately
350 feet south of 104th Street, from District CP-1 (Neighborhood Planned
Business Center) to District C-2-p (Local Retail Business - Limited District),
and approving a preliminary plan for the same. (8092-P-6)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2615, rezoning
an area of approximately 2.77 acres generally located on the east side of Blue
Ridge Boulevard, approximately 350 feet south of 104th Street, from District
CP-1 (Neighborhood Planned Business Center) to District C-2-p (Local Retail
Business - Limited District), said section to read as follows:
Section 65.010A2615. That an area legally described
as:
All of Lot 1, Blue Ridge Commercial Center, a
subdivision in Kansas City, Jackson County, Missouri, except the south 65
feet thereof.
is hereby rezoned from District CP-1 (Neighborhood
Planned Business Center) to District C-2-p (Local Retail Business - Limited
District), all as shown outlined on a map marked Section 65.010A2615, which is
attached hereto and made a part hereof, and which is hereby adopted as a part
of an amendment to the zoning maps constituting a part of said chapter and as
an amendment to Section 65.010 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any necessary improvements as required by the
City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer contribute to the
I-435/I-470 Corridor Study Improvement Fund based on a rate of $8.00
per gross square foot of drive-in space and $2.00 per gross
square foot of commercial retail space.
5. That the developer extend water mains as
required by the Water Services Department.
6. That the developer provide for fire protection
as required by the Fire Department.
7. That the developer provide a cross-access
easement to the property to the north; provided that said easement
will be deferred until such time as requested by the
property owner to the north.
8. That the developer retain the existing trees
along the easterly boundary and that the existing fence be repaired
and maintained.
9. That the developer submit a final plan for each
phase to the City Plan Commission for approval, including detailed
information on signage (including elevations),
landscaping, and screening. Such final plan
for Phase 1 shall include a five foot wide
landscaped island located south of Phase 1.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 951425, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
