COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 050483

 

Approving an amendment to the Market Square Area Plan by modifying the Land Use Plan and Map for an area of approximately 3.3 acres generally located on the east side of Oak Street between 2nd Street and 3rd Street to recommend mixed use/residential, commercial, office instead of industrial, warehouse, office.

 

  WHEREAS, by Resolution No. 56871 adopted September 13, 1984, the City adopted the Market Square Area Plan as a guide for development and redevelopment of that area generally bounded by the Missouri river on the north, Bluff Drive on the west, 6th Street Trafficway (I-70) on the south and Locust Street Trafficway on the east; and

 

WHEREAS, said Market Square Area Plan was amended on May 18, 1989, through the adoption of Resolution No. 63985; was amended on September 17, 2001, through the adoption of Resolution No. 011285; and was further amended on May 6, 2004, through the adoption of Resolution No. 040419; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Market Square Area Plan as it affects that area of approximately 3.3 acres generally located on the east side of Oak Street between 2nd Street and 3rd Street to recommend mixed use/residential, commercial, office instead of industrial, warehouse, office; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on May 2, 2005; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on May 17, 2005; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on May 17, 2005, recommend approval of the proposed amendment to the Market Square Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the fourth amendment to the Market Square Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area of approximately 3.3 acres generally located on the east side of Oak Street between 2nd Street and 3rd Street to recommend mixed use/residential, commercial, office instead of industrial, warehouse, office. A copy of the amended Market Square Area Plan and Map is attached
hereto as Exhibit A and made a part hereof.

 


Section B. That the amendment to the Market Square Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for

 

Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
