ORDINANCE NO. 960066

 

Approving the preliminary plat of Blue Jacket on approximately a 5.0 acre tract of land generally located west of N. Main Street at N.E. 115th Street. (SD 0720)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Blue Jacket on approximately a 5.0 acre tract of land generally located west of N. Main Street at N.E. 115th Street, and more specifically described as follows:

 

All that part of the Southwest Quarter of Section 23, Township 52, Range 33, Clay County, Missouri, described as follows: Beginning at the northeast corner of Lot 7, Nashua Acres; thence westerly along the north line of Nashua Acres 564.86 feet to the northwest corner of Lot 6, Nashua Acres; thence northerly along the easterly line of Old Highway 169 (now N. Oak Trafficway) a distance of 74.89 feet; thence easterly at right angles to the last described line a distance of 5 feet; thence northerly along the easterly line of said Old Highway Rt. 169 a distance of 295.06 feet; thence easterly and parallel with the north line of Nashua Acres a distance of 669.51 feet to a point in the west line of Old Highway Rt. 71; thence southerly along the west line of Old Highway Rt. 71 a distance of 353.50 feet to the point of beginning, except that portion lying within the right of way of Missouri State Highway 169, all in Kansas City, Clay County, Missouri. Said tract of land contains 5.00 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval and that improvements be made as required by

the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer improve the west half of N. Main Street to collector street standards.

 

5. That the developer construct sidewalks on the west side of N. Main Street.

 

6. That the developer grant an Aviation and Noise Easement to the City.

 

7. That the developer secure the approval of the Street Naming Committee for all street names prior to submittal of the first final plat.

 

8. That the developer install hard surface roads prior to construction beyond foundations.

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

12. That the developer secure a permit from the Missouri Highway and Transportation Department prior to working in any State right of way.

 

13. That the developer pay money in lieu of parkland dedication in the amount of $4,156.27 for 22 dwelling units in satisfaction of Section 66-128 of the Subdivision

Regulations.

 

14. That the developer petition for the vacation of a portion of N. Nashua Drive (N. Oak Trafficway) as proposed by the Beacon Hill preliminary plat prior to recording of any

final plat of Blue Jacket containing lots abutting N. Nashua Drive.

 

15. That the developer construct a temporary cul-de-sac as required by the City Engineer's Office if this plat is developed in phases.

 

16. That the developer include the following language on the final plat for the buffer strip on that portion of lots within fifty feet of the U.S. Highway 169 right of way : "This

strip reserved for the planting of trees or shrubs by the owner or developer; the

building of structures hereon is prohibited."

 

17. That the developer submit a street tree planting plan with the final plat to the City Forester for approval and secure the approval of the City Forester for the spacing and

species of trees.

 

18. That the developer secure approval of a Certificate of Survey prior to the sale of any individual units.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 960066, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
