ORDINANCE NO. 030557

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0482, rezoning an area of approximately 1.66 acres generally located on the east side of Hickman Mills Drive approximately 300 feet north of 109th Terrace from District R-3 (Low Apartments, Low Density) to District C-1-p (Neighborhood Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0482, rezoning an area of approximately 1.66 acres generally located on the east side of Hickman Mills Drive approximately 300 feet north of 109th Terrace from District R-3 (Low Apartments, Low Density) to District C-1-p (Neighborhood Retail Business - Limited District), said section to read as follows:

 

Section 80-11A0482. That an area legally described as:

 

All that part of the Northeast Quarter of Section 2, Township 47 North, Range 33 West of the Fifth Principle Meridian in Kansas City, Jackson County, Missouri, described as follows: Commencing at the northeast corner of Lot 1, Bowers and Kenneys Addition, a subdivision in Kansas City, Jackson County, Missouri; thence South 89E15'04" West, along the north line of said subdivision, a distance of 434.81 feet to the point of beginning; thence South 89E15'04" West, continuing along said north line, a distance of 199.42 feet (Deed reads 200.00 feet) to a point on the easterly right of way line of Hickman Mills Drive (formerly U.S. Highway 71), as now established; thence along a curve to the right along said easterly line, having an initial tangent bearing of North 06E48'20" west a radius of 1095.92 feet, an internal angle of 00E19'05", a distance of 6.08 feet; thence North 05E21'00" West, along said easterly line, a distance of 358.72 feet to the southwest corner of Lot 18, Harting Acres, a subdivision in Kansas City, Jackson County, Missouri; thence North 89E15'04" East, along the southerly line of said Harting Acres, a distance of 199.56 feet, to a point that is 456.35 feet west of the southeast corner of Lot 19, Harting Acres, as measured along the south line; thence South 05E21'00" East, a distance of 364.79 feet (Deed reads 362.99 feet) to the point of beginning. Containing 1.66 acres, more or less.

 

is hereby rezoned from District R-3 (Low Apartments, Low Density) to District C-1-p (Neighborhood Retail Business - Limited District), all as shown outlined on a map marked Section 80-11A0482, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval at the time of the submittal of the first plat and a detailed micro storm drainage study for each phase at the time of final platting and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer dedicate additional right of way for Hickman Mills Road as required by the Department of Public Works so as to insure 40 feet of right of way as measured from the centerline of Hickman Mills Road.

 

6. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

7. That the developer extend sanitary and/or storm sewers and determine their adequacy as required by the Department of Public Works.

 

8. That the developer show the limits of the 100 year floodplain on the final plat.

 

9. That the developer show the lowest opening or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year flooding area on the final plat.

 

10. That the developer insure adequate sight distance for any access point onto Hickman Mills Road as required by the Department of Public Works.

 

11. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including photometric study, with a uniformity ratio not to exceed 6:1, a maximum glare value (Lkymas/Lavg) less than 0.3, and light trespass at the property line not to exceed 8 lux) and building elevations, with building exterior materials to consist of brick, masonry, stone, stucco or horizontal lap siding, and screening of rooftop equipment from the street and adjacent residential uses.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 030557, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
